THE abortion referendum looks like it will be passed by a narrow majority but success is by no means certain at this stage, according to the latest Sunday Independent/Kantar Millward Brown opinion poll.

Excluding undecided voters, the poll finds 57pc to 43pc support repealing the Eighth Amendment of the Constitution, which recognises the equal right to life of the mother and unborn.

The proposed abortion law in Ireland which will come in if the Eighth Amendment is repealed will be much more restrictive than the law in Britain, a legal expert has said.

Fiona De Londras, Professor of Global Legal Studies at the University of Birmingham, said there is no provision for unrestricted abortion up to six months under the proposed Irish law except in extreme circumstances.

The Irish abortion regime will remain as it is until new legislation is passed, even if the referendum on removing the abortion provision in the Constitution is passed on May 25th.

How long it will take for the Oireachtas to pass a new law is unclear, but it could be done before the end of the year. However, should the Government fall in the meantime, that timetable would most likely be extended.

There have been almost 30 referendums since the Constitution was adopted in 1937. I have covered the vast majority of them in my journalistic career. There have been more abortion questions put to the people in referendums than any other single issue in the history of the State. So, I have become something of a specialist on abortion. The referendum on May 25th is the sixth time around for me.

The first time was on September 7th, 1983, when the Eighth Amendment was put into the Constitution. It is hard to believe that it was held almost 35 years ago. This means every voter under the age of 53 years or so, depending on their political awareness, has no personal memory of that campaign.

Sinn Féin has called on the Government to ensure legislation to allow for abortion in certain circumstances is introduced by early autumn, if the Eighth Amendment is removed from the Constitution.

The party formally launched its campaign to repeal Article 40.3.3 of the Constitution yesterday and insisted it would canvass in every county for a Yes vote.

Legal consultant to the Pro Life Campaign, Caroline Simons said Minister for Health Simon Harris was seeking to present the proposal to allow abortion up to 12 weeks in all cases as somehow being restrictive.

The headline in the Irish Examiner confirmed that all was not well in Cork. “Coveney plan for legal lock in tatters,” the newspaper declared on Wednesday as the tanaiste, a local TD, made the news for the third day running.

“Tanaiste Simon Coveney has been left humiliated after his two-thirds Dail majority legal-lock plan for the government’s post-referendum abortion law was labelled unconstitutional, naive and deeply damaging to the ‘yes’ campaign,” the Examiner railed.

After years of discussion parliament on Friday passed with an overwhelming majority a law decriminalising abortion.

The controversial matter – which had remained largely stagnant out of fear of reprisal from the church – was voted into law with 33 votes in favour, eight against and five abstentions.

It allows termination of an unwanted pregnancy up to 12 weeks of gestation. In case of rape, an abortion can take place up to 19 weeks.

Ireland’s deputy premier has changed his stance on potential new abortion laws for the country by backing terminations up to 12 weeks into pregnancy.

The Government intends to table legislation that would permit women to abort within 12 weeks if citizens vote to repeal Ireland’s strict constitutional position on abortions in this summer’s anticipated referendum.
