Appeals court rules in Biden’s favor on abortion referrals

A court has allowed federally funded family planning clinics to continue to make abortion referrals for now

COLUMBUS, Ohio -- Federally funded family planning clinics can continue to make abortion referrals for now, a federal court ruled Tuesday, in a setback for a dozen Republican attorneys general who have sued to restore a Trump-era ban on the practice.

The 6th U.S. Circuit Court of Appeals in Cincinnati denied a request by the 12 states to pause rules for the federal government’s family planning program while their case is heard. The states were eager to stop implementation before the next round of federal grants starts rolling out in March.

The Supreme Court has been sitting on a potentially very significant abortion case for the last two months, one that the Court’s rules say it should dismiss. We’re likely to find out this week whether the Court will dismiss this case, however, and that decision could tell us a great deal about how fast the Court plans to move in rolling back abortion rights.

In February, about a month after President Joe Biden took office, the Supreme Court announced that it would hear three consolidated cases challenging a Trump administration policy targeting abortion clinics.

WASHINGTON — The Biden administration on Wednesday began to undo a Trump-era ban on clinics referring women for abortions, a policy that drove Planned Parenthood from the federal family planning program and created new complications for women trying to get birth control.

The proposed rule from the Department of Health and Human Services follows through on President Joe Biden's campaign promise to reverse his predecessor's family planning policy, which was branded a “gag rule” by women's groups and decried by medical associations as violating the doctor-patient relationship.

New rules proposed Wednesday would largely return the Title X program to its
pre-Trump formation, allowing more abortion clinics to participate in a program

Washington (CNN) The Biden administration asked the Supreme Court late Friday to dismiss a dispute over a Trump era rule barring federally funded health care providers in the Title X family planning program from referring patients for abortions.

In a petition to the court filed after hours
on Friday, Acting Solicitor General Elizabeth Prelogar said the parties had
agreed to dismiss the case that the justices had agreed to hear last month.

Planned Parenthood said on Monday it is pulling out of the United States federal family planning programme rather than abide by a new Trump administration rule prohibiting clinics from referring women for abortions.

Alexis McGill Johnson, Planned Parenthood's acting president and CEO, said the organisation's nationwide network of health centres would remain open and strive to make up for the loss of federal money. But she predicted that many low-income women who rely on Planned Parenthood services would "delay or go without" care.

Aug. 19 (UPI) -- Facing a Monday deadline to inform the government how it plans to comply with a new rule that bars Title X funds for organizations that provide access to abortion, Planned Parenthood said it's effectively being forced from the federal family planning program in a move that will impact millions of Americans.

Planned Parenthood has said it has no choice but to leave the program, due to the rule, unless a federal court steps in. The organization said it would announce its next steps Monday afternoon.
