USA – Fearing Legal Threats, Doctors Are Performing C-Sections in Lieu of Abortions

Some physicians are doing unnecessary and invasive surgery on pregnant patients “to preserve the appearance of not doing an abortion.”

When news that Lizelle Gonzalez was suing the local prosecutor’s office for more than $1 million in damages, after being falsely imprisoned for murder over an attempted self-managed abortion in 2022, reproductive rights advocates cheered the move as a pathway to justice for the wrongfully charged southern Texas woman. However, a revelation in the lawsuit gave them pause: At the same hospital that reported her self-induced abortion to authorities, Gonzalez underwent a “classical C-section” for the delivery of her stillborn child, instead of abortion care. Major invasive surgery, Cesarean sections carry much higher risk for health complications, like hemorrhaging, compared with D&E abortion, and can jeopardize subsequent pregnancies.

Sami Stroebel, an aspiring obstetrician-gynecologist, started medical school at the University of Wisconsin in Madison last summer within weeks of the Supreme Court's decision to overturn the constitutional right to an abortion.

"I sat there and was like, 'How is this going to change the education that I'm going to get and how is this going to change my experience wanting to provide this care to patients in the future?'"

Doctors in states with abortion bans can face prison time and lose their licenses if they violate the laws. Some are calling on doctors to openly defy the bans.

RACHEL MARTIN, HOST: It's been five months since Roe v. Wade was overturned, and now 13 states have laws banning abortion with limited exceptions for medical emergencies. Doctors who violate these laws could face felony charges, prison time and the loss of their medical license. Surveys, news reports and court affidavits show the fear of these laws has caused some doctors to delay or deny abortions, including in emergencies. Some doctors are asking themselves a tough question - when they are forced to choose between their ethical obligations to patients and the law, should they defy the law? NPR's Selena Simmons-Duffin reports.

Accessing abortion has become increasingly difficult in parts of the US. As a result, a growing number of reproductive rights activists say it is time American women learn the facts about "self-managing abortion" with pills.

Kate could tell something was wrong. She'd been feeling nauseous for days and her body just felt different. The 27-year-old massage school student and her boyfriend were supposed to leave on a short road trip together, but before they hit the highway, she asked him to drive to a local drugstore.
