The Supreme Court’s 29 September 2022 decision on abortion has provided legal armour for many pending cases on reproductive justice related to, among others, surrogacy, assisted reproduction and marital rape. But its impact on access to safe abortion will be limited.

Bengaluru: X* is a 25-year-old woman from Manipur, the eldest of five siblings and the daughter of farmers. She was living in Delhi with her unmarried partner. In June, 2022, X found out that she was pregnant and was set to marry her partner.

Although abortion is legal, over two-thirds of abortions in India are considered to be risky. Barriers to safe abortion include a shortage of doctors in rural areas, a lack of confidentiality and widespread stigma.

Chitra (name changed) had to travel more than 40 kilometers (25 miles) from her home to the city of Gurgaon to get an abortion so that her family members would not find out.

"The contraceptive failed, and I did not wish to have a child," she said. "I was repeatedly questioned and treated rudely by the doctors as well as nurses and other staff at the clinic," the 20-year-old student told DW.

The seventh and final season of Orange Is The New Black is live on Netflix, and considering many people will be binge-watching it this weekend, we need to talk about the abortion plot in episode 11. (Spoilers ahead.)

In that episode towards the end of the season, Chaj, a Guatemalan woman in Litchfield's Immigration and Customs Enforcement (ICE) holding pen, is desperately trying to communicate, but no one understands Ki'che, the indigenous language she speaks. She eventually ends up in the medical unit sobbing, with severe abdominal pain and period spotting, where she's finally granted a translator. It's revealed then that she was raped, so she drank an herbal tea made with parsley in an attempt to have an abortion.

Many a time, I’ve uninhibitedly, at times vociferously, voiced my opinion in the pro-life versus pro-choice debate. When statistics, opinions, arguments fail, I go back to a classic tweet by noted science fiction writer, Patrick S. Tomlinson, which asks you to choose between saving a 5-year-old child and a 1,000 viable embryos in a fire. As expected, he never got a clear response to this question. While such discussions would be held at a very rudimentary level, whenever I’d think of several other factors, such as the woman’s age, family situation, financial means, and most importantly, her choice, I’d always rest comfortably on the pro-choice side of the debate without a second thought. Until one fine day, I googled some India stats and the bubble burst. The right to abortion in India (there is one, yes) does not remotely consider the idea of choice.
