Northern Ireland drags feet on abortion a year after UK orders roll-out

BELFAST (Reuters) - Almost a year after the British parliament voted to legalise abortion in Northern Ireland, one of the last regions in Western Europe with a ban, women there face gaps in provision due to renewed local political roadblocks.

The region's socially conservative health minister Robin Swann has declined to order the health service to provide abortions, commission information campaigns, and also declined to introduce emergency telemedicine measures offered in the rest of the United Kingdom during the COVID-19 pandemic.

Pressure is growing on the government to reform Northern Ireland’s restrictive abortion laws after the supreme court concluded that they are incompatible with human rights legislation.

Justices at the UK’s highest court dismissed a legal challenge by a narrow majority of four to three and said they had no jurisdiction to consider the latest case because there was no actual or potential victim of an unlawful act involved in it.

As in Ireland up to now, it is almost impossible to get an abortion in Northern Ireland. The most immediate fallout of the Irish referendum results on 26 May was the call from many quarters for Northern Ireland to be next. However, there are complex political realities that will get in the way. The first and most important is that policy on abortion was devolved by the UK Parliament to Northern Ireland and Scotland some years back, as part of changes introduced by the then Labour government to give Scotland, Wales and Northern Ireland more local control over a range of issues.

The problem now is that Northern Ireland hasn’t had a functioning government for more than a year, so there is no way it can act. Secondly, there is no guarantee its government would reform the abortion law even if it suddenly got back on its feet. One of the strongest and most reactionary Northern Irish parties, the Democratic Unionist Party (DUP), is dead set against legalising abortion. Moreover, they currently have a controlling say in the politics of the UK overall, because the Conservative Party does not have a parliamentary majority, and they made a deal with the DUP last year after the election to support them to get unpopular legislation through.

Medical staff in Northern Ireland have been told they will not face prosecution if they refer women to clinics in England and Wales for abortions, a development that campaigners say will ease the climate of fear under which many have been operating.

In a significant clarification of the law, the director of public prosecutions for Northern Ireland, Barra McGrory, has said he does “not see the issue of criminal liability arising in the context of NHS staff advising or informing patients of the availability of abortion services in England and Wales”.

Northern Irish appeal court refuses limited lifting of abortion ban

Three appeal court judges have refused to legalise abortions in Northern Ireland’s hospitals in cases where women are made pregnant through rape or where pregnancies are doomed due to fatal foetal abnormality.

The ruling in the court of appeal in Belfast also passed on responsibility for any changes to the region’s strict anti-abortion regime to a Stormont assembly that may not exist after Thursday’s devolution deadline.
