The Texas abortion case blows up the abortion ban rationale

Abortion rights activists, medical professionals and ordinary women warned the Supreme Court in advance of the Dobbs v. Jackson Women’s Health Organization decision: Legislatures cannot dictate medical decisions without creating horrendous injustices and medical travesties. A recent case from Texas, which has a ban on abortions after six weeks, leaves no doubt about the merits of that argument. The Texas case undermines the rationale for abortion bans and adds to Republicans’ political liability on an issue uppermost in the minds of many voters.

As the Texas Tribune aptly put it, “For the first time in at least 50 years, a judge has intervened to allow an adult woman to terminate her pregnancy.”

A year after Dobbs, the pro-choice movement has never been stronger

A year after the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization stripped women of nearly 50 years of constitutional protection to make their own health-care decisions, women have faced trauma and near-death experiences and been deprived of medical care. That includes women who never contemplated having an abortion. The Dobbs-aggravated shortage of doctors practicing obstetrics-gynecology, especially in rural areas, leaves millions of women without access to health care.

A recent KFF survey of 569 OB/GYNs underscores the health-care crisis Dobbs has wrought. Twenty percent of respondents “report they have personally felt constraints on their ability to provide care for miscarriages and other pregnancy-related medical emergencies since the Dobbs decision.” Forty-four percent of doctors “and six in ten practicing in states where abortion is banned or where there are gestational limits, say their decision-making autonomy has become worse since the Dobbs ruling.” And 36 percent nationally “say their ability to practice within the standard of care has become worse.”

A viral image swept across Twitter this weekend depicting a young person in Texas protesting the state’s stay-at-home order, which is helping to save lives during the COVID-19 pandemic. The woman held a sign with a familiar phrase to those of us fighting for reproductive freedom: “My Body, My Choice.”

But displayed prominently alongside the line was a crossed-out face mask, the kind that medical experts, state and local officials, and even members of the Trump administration (no thanks to President Trump himself) have resoundingly said should be worn in public to protect our communities against the spread of the coronavirus.
