President Michael D Higgins is expected to sign the abortion referendum bill into law next week, deleting the constitutional ban on abortion and paving the way for the government to introduce legislation allowing for abortion to the Dáil in the coming weeks.

The Supreme Court on Friday decided that there were no grounds to hear an appeal of a decision by the Court of Appeal last month which upheld the High Court’s rejection of a challenge to the abortion referendum result.

THE COURT OF Appeal has dismissed a Dublin woman’s challenge against the abortion referendum result.

Joanna Jordan from Dún Laoghaire, Co Dublin, had appealed last month’s ruling by High Court President Justice Peter Kelly who ruled that neither Jordon met the necessary legal test set by the Referendum Act before a court can permit a petition to be brought.

A Dublin woman’s attempt challenge to the result of May’s abortion referendum has been dismissed by the Court of Appeal.

Joanna Jordan, from Upper Glenageary Road, Dún Laoghaire, had appealed a ruling by High Court President Mr Justice Peter Kelly, who last month said she had not met the necessary legal test set by the Referendum Act before a court can permit a petition to be brought.

The State and Referendum Commission are entitled to their legal costs, estimated at more than €200,000, of successfully opposing two separate bids to challenge the abortion referendum result, the president of the High Court has ruled.

One of the two, Joanna Jordan, said she intends to appeal the refusal to let her bring a petition challenging the result. In that context, a stay applies until at least Friday preventing the referendum result being formally certified

The president of the High Court has refused two separate applications for permission to bring petitions challenging the Yes result of the abortion referendum.

Mr Justice Peter Kelly also made an order with the effect the referendum result cannot come into formal effect for at least a week to allow Charles Byrne seek an appeal to the Court of Appeal.

Government ministers do not have to meet standards of “legal accuracy” when campaigning in referendums and only an extreme situation might entitle the courts to intervene in their campaigning, the State has told the High Court.

No such situation arose concerning how Taoiseach Leo Varadkar and Minister for Health Simon Harris campaigned in favour of repealing the anti-abortion Eighth amendment, Frank Callanan SC said.

A man seeking leave to challenge the result of last month’s abortion referendum will formally apply this week for court orders requiring the State to provide him with the original and supplemental electoral registers of voters, including the dates of birth of voters.

Charles Byrne, of College Rise, Drogheda, Co Louth, also wants marked registers of all those who voted on May 25 so the material can be analysed by a public administration expert, his counsel Kenneth Fogarty SC said

The president of the High Court has fixed June 26th for hearing three separate applications for permission to challenge the result of the referendum on the Eighth Amendment.

One of the challengers, Charles Byrne, who has raised concerns about whether a number of student voters at NUI Galway were properly registered, also wants copies of the marked register of voters.
