The nation’s most restrictive abortion law remains in place for now, after a federal appeals court on Thursday sided with the state of Texas.

In a 2-to-1 order, the U.S. Court of Appeals for the 5th Circuit refused the Justice Department’s request to reinstate an earlier court ruling that temporarily lifted the ban, which bars abortion as early as six weeks into pregnancy and makes no exceptions for rape or incest.

When a federal court injunction temporarily halted Texas’ controversial six-week abortion ban on the night of Oct. 6, one physician who provides abortions at an independent clinic in the state was already in bed. A text message arrived with the news and the physician’s heart started racing.

“This is what we’ve been planning for. This is great news,” the doctor remembers thinking. “It was always my intention that if we got the injunction, I would resume care as soon as possible.”

A U.S. federal appeals court Friday night quickly allowed Texas to resume banning most abortions, just one day after clinics began racing to serve patients again for the first time since early September.

A one-page order by the 5th U.S. Court of Appeals reinstated the nation's strictest abortion law, which bans abortions once cardiac activity is detected, usually around six weeks. It makes no exceptions in cases of rape or incest.

It would be difficult to overstate the significance of this year’s elections for the future of abortion in America. The results could eventually determine whether Roe v. Wade is overturned by the Supreme Court or codified by Congress.

Normally, stakes that high would make abortion a primary focus of the 2020 campaign. But normally, the country wouldn’t be experiencing a pandemic, a recession and a civil rights movement all at once. On Night 1 of the Democratic National Convention, the sum total of the attention abortion received was the second it took Kamala Harris to say “reproductive justice” in a video montage.

DALLAS — Two reproductive rights groups have dropped their lawsuit against seven small East Texas towns that had declared abortion-rights organizations “criminal organizations” in anti-abortion ordinances that prohibit them from operating within city limits.

The American Civil Liberties Union of Texas said Wednesday that the lawsuit had achieved its purpose of compelling the towns to revise their ordinances “to allow pro-abortion organizations to operate within the cities and stop calling them ‘criminal,'” said Imelda Mejia, spokeswoman for the ACLU of Texas.
