PEPFAR Reauthorization: The Debate About Abortion

Despite a long history of broad and bipartisan support, reauthorization of the President’s Emergency Plan for AIDS Relief (PEPFAR) is currently being held up by congressional debate around abortion. PEPFAR, first created in 2003 by President George W. Bush and reauthorized three times thus far, is the U.S. government’s signature global health effort in the fight against HIV. Widely regarded as one of the most successful programs in global health history, PEPFAR reports having saved 25 million lives due to its efforts, and KFF analyses have found a significant impact of the program beyond HIV, including large reductions in both maternal and child mortality and significant increases in some childhood immunization rates. Still, its fourth reauthorization has been drawn into broader U.S. political debate about abortion, in the wake of the Supreme Court’s Dobbs v. Jackson Women’s Health Organization decision (which overturned the nationwide right to obtain an abortion), even though U.S. law prohibits the use of U.S. foreign assistance, including PEPFAR funding, for abortion. This policy watch provides an overview of the current debate and issues.

The whole world is watching for Biden’s plan to protect abortion rights

The first year of Joe Biden’s presidency came to a close just days before the 49th anniversary of the Supreme Court’s landmark ruling in Roe v. Wade, which has served as the foundation for Americans’ right to abortion ever since. Yet, it could be the last anniversary we ever celebrate.

In the next six months, the Supreme Court is set to rule in a case aimed directly at dismantling the constitutional protections established by Roe. Given the realities of a conservative Supreme Court and gridlock in Congress, executive branch leadership and support of abortion is critical. The time is now for the Biden administration and federal agencies to take every measure necessary to protect abortion access. But it shouldn’t stop at creative domestic approaches — an international perspective is also needed.

Reproductive Rights Advocates Call for Biden to Curb Foreign Abortion Restrictions

A coalition of over 140 reproductive rights and health care advocates is calling on President Biden to mitigate the harm caused by the over-implementation of U.S. foreign aid restrictions, especially the 50-year-old Helms Amendment, which has limited access to and information about abortion overseas.

In the April 29 letter, advocates highlighted
the direct harm these restrictions cause women, especially victims of
conflict-related sexual violence, and their violation of the U.S.’s human
rights obligations to ensure gender equality and non-discriminatory,
comprehensive health care. While these restrictions were enacted by Congress,
the coalition is advocating for the Biden administration to curb their impact
and support efforts currently underway to repeal them—both to fulfill his
stated policy of support for sexual and reproductive health and rights (SRHR)
and to provide the same bold leadership on abortion that he has shown in other
areas such as climate change, jobs and infrastructure.

Biden urged to end US aid ‘abortion ban’

More than 140 rights groups call for repeal of 1973 Helms amendment widely misinterpreted as total ban on funding abortion services overseas

Joe Biden is being urged to clarify a longstanding US law restricting overseas aid that has been misinterpreted by successive administrations as an outright ban on funding abortion for any reason.

As the US president marked his first 100 days in office on Friday, more than 140 human rights and global health organisations, including Human Rights Watch, Amnesty International US and the Global Justice Center, signed a letter asking him to confirm that US aid can be used for abortion care in cases of rape, incest and when the woman’s life is in danger.

Part 1: The Helms Amendment and Freedom of Speech

This is the first of a two-part post exploring how U.S. restrictions on abortion-related speech, activities, and funding violate U.S. human rights obligations under the ICCPR. Although much attention is rightfully paid to the devastating impact of the reimposed Global Gag Rule, the Helms and Siljander Amendments (which have been permanently in place since the 1970s) often command less consideration. These restrictions are discussed separately here in order to illustrate their unique effects on freedoms of speech and association. However, Helms, Siljander and the Global Gag Rule all fall short of the ICCPR’s requirements and therefore violate freedoms of speech and association in complex ways, as examined in more detail in the Global Justice Center’s recent brief. This post explores how the Helms and Siljander Amendments fail to meet the ICCPR’s standards for lawful restrictions on the freedom of speech. Part Two will focus on the Global Gag Rule and its violation of the freedom of association.
