Abortion is a topic that has been very sensitive over the years. When people are asked about their opinion, they throw the ‘abortion is a crime’ statement with no further room for debate.

Dozens of women access abortion and post-abortion services yearly whether safe or unsafe. Abortion is protected by the constitution under Article 26 (4).

On a rainy morning in May 2019, Dr. John Nyamu was attending to patients on the cluttered first floor of an office building in downtown Nairobi when he heard raucous shouts from down the street. A caravan of protesters was winding toward him, a few hundred people teeming in the streets, bellowing through loudspeakers, and stopping traffic.

As the crowd reached his building, Nyamu, a well-known gynecologist who performs abortions in a private clinic, peered through his window at the protesters below to make out what they were saying. It turns out they were targeting him. “Abortion is murder! Abortion must go! Nyamu must go!” Some held signs with photos of mutilated fetuses. Others clutched baby-size cardboard coffins with crosses on them.

When Shali Iminza, 27, missed her period in March, the married mother of three felt her stomach sink with dread. Iminza, whose first name has been changed for privacy reasons, works as a farmer in western Kenya, and her husband is a motorcycle taxi driver. Together, they barely make enough money to feed their family. “Sometimes we eat three times [per day], sometimes two,” Iminza told Foreign Policy and Type Investigations over the phone. “Things are very expensive, and to get money nowadays, it’s hard.”

Unable to care for another child, Iminza visited a local health clinic, walking more than 3 miles to save money on the taxi fare. When she arrived, the doctor informed Iminza that the pills she would need to terminate her pregnancy were unavailable because of shortages caused by the novel coronavirus. “I’m very angry because the more the days are going, the pregnancy is now growing, so I don’t know what to do,” said Iminza, her voice trembling from stress.

Marie Stopes clinics has complied with conditions set by the government for it to provide abortion services in the country.

The conditions, which are aimed at stiffening the regulation of reproductive health services in the country, were issued by the Medical Practitioners and Dentists Board on November 14.

Citing safety risks, the board imposed a ban restricting the reproductive health clinic from conducting abortions in the country.

The Kenyan government has lifted a ban preventing the international charity Marie Stopes from providing any abortion services, following warnings the ruling endangered the lives of thousands of women.

The Kenyan ministry of health said on Thursday that an audit of Marie Stopes’ clinics had been completed and that the charity could resume post-abortion care services under “regular supervision”.

The ban on abortions in Marie Stopes clinics has been lifted just hours after Kenyans online pleaded with the Health Cabinet Secretary Sicily Kariuki.

Using the hashtag #DearCSSicilyKariuki, Kenyans on Twitter urged the minister to give a chance to professionally procured abortions and prevent deaths that may occur during backstreet abortions.

Health Cabinet Secretary Sicily Kariuki has lifted the ban on post-abortion care services by Marie Stopes Kenya and ordered its full compliance with relevant laws.

In a statement on Thursday, Ms Kariuki directed the company to observe all laws that cover its work, as stated in article 26(4) of the Constitution.

Marie Stopes is a global organisation that provides contraception and safe abortion to women in urban and rural communities.
