The Abortion Justice Act Is the Reproductive Rights Legislation the US Needs

While the act may have little chance of passage, it’s a message to those who need an abortion that they are not alone.

Marking the tragic one-year anniversary of Dobbs v. Jackson Women’s Health Organization in which the Supreme Court struck down Roe v. Wade, a group of progressive Democrats in the House of Representatives unveiled their latest attempt to protect abortion rights: the Abortion Justice Act.

Introduced by Rep. Ayanna Pressley (D-Massachusetts), chair of the Pro-Choice Caucus’s Abortion Rights and Access Task Force, and Rep. Cori Bush (D-Missouri), this latest attempt at securing federal abortion rights goes beyond simply codifying Roe — it would provide a unique federal pathway to achieving reproductive justice.

House Democrats will keep a decades-old ban on government funding for abortion in spending bills this year, dodging an election-year clash with Republicans and disappointing liberal lawmakers and activists.

Senior Democrats had been considering scrapping the so-called Hyde amendment, which has restricted federal funding for most abortion services since 1976, amid a hard push from the party’s left flank.

Nowhere to “Hyde”: Congressional Democrats target restriction on federal abortion funding

For over 40 years, the Hyde Amendment has barred any federal money from being used to pay for abortions, except for in some cases involving rape, incest or instances where the mother may lose her life. Although the amendment is just a rider on the annual appropriation bill to fund the Health and Human Services Department, in every year since 1976, Congress has approved the measure. Those days may now be over.

In response to President Donald Trump endorsing making the Hyde Amendment a permanent law during his campaign, Democratic Congresswomen Barbara Lee (D-Calif.), Jan Schakowsky (D-Ill.), Diana DeGette (D-Colo.) and former New York representative Louise Slaughter, who has since died, introduced the Equal Access to Abortion Coverage in Health Insurance Act, or EACH Woman Act, in January 2017 to allow any woman who has health insurance through the federal government to have access to all reproductive care services, including abortion.
