Criminalisation is necessary to protect women from forced abortions, says Minister

Attempts to fully decriminalise abortion as part of new legislation have failed following a debate in the Dáil.

A number of TDs called on Minister for Health Simon Harris to support amendments to the Regulation of Termination of Pregnancy Bill which would see doctors protected from criminalisation where they act in good faith, and which would drop the current 14 year jail term.

After three days of intense debate that was often impassioned and deeply personal, only one of 180 amendments to the abortion bill was accepted.

Simon Harris, the health minister, added a clause that will mean the bill legalising terminations will be reviewed after five years. However, that will be shortened to three years at a later stage. The legislation was being examined by a select health committee.

Women who are certified for a medical abortion are likely to have to make three visits to their GP, the Oireachtas health committee has heard.

Dr Michael Harty, chairman of the committee and who is also a GP, said it was important the woman gets a face-to-face consulation with the doctor.

Consideration of the Regulation of Termination of Pregnancy Bill at Committee Stage has ended tonight following three days of examination.

The Select Oireachtas Committee on Health spent three days discussing 180 amendments to the legislation.

The Minister for Health did not accept any changes to the legislation.

The Committee has so far examined almost 130 amendments of 180 tabled in relation to a Bill to allow for abortion in this country.

SIMON HARRIS HAS said the word ‘abortion’ is not mentioned in the Regulation of Termination of Pregnancy Bill due to legal advice.

The Health Minister and members of the Oireachtas Health Committee are meeting today to consider amendments to the Regulation of Termination of Pregnancy Bill.

A number of TDs want the wording of the Bill to be changed, with Solidarity–People Before Profit TD Bríd Smith saying not using the word ‘abortion’ is an “obfuscation and a deliberate ignoring what’s going on here”.

Minister for Health Simon Harris argued that the public did not “vote for abortion in all circumstances” earlier this year as he resisted calls for all regulations surrounding the termination of pregnancy not to carry a criminal sanction if breached.

The Minister was speaking as the Oireachtas Health Committee debated some of the 180 proposed amendments to the Health (Regulation of Termination of Pregnancy) Bill 2018 put forward by pro-choice and anti-abortion TDs.

Pro-choice campaigners have taken abortion pills outside Northern Ireland’s main court buildings in defiance of the strict laws governing terminations.

Northern Ireland is the only part of the UK where the procedure is not legal, aside from exceptional cases, and the Republic has voted to allow it in early pregnancy.
