In the final months of 2017, the Trump administration tried and failed to block three undocumented teenagers from getting abortions while in the custody of the Office of Refugee Resettlement. In each case, the young women sought access to the procedure only to be refused by the agency, which cited a policy issued in March barring “any action that facilitates” abortion for unaccompanied minors, including “scheduling appointments, transportation, or other arrangements,” unless approved by agency director Scott Lloyd.

That approval would likely never come, even in cases of rape, because, according to a letter from Lloyd, to allow minors in ORR custody to terminate their pregnancies would be the equivalent of “being asked to participate in killing a human being in our care.”

HOUSTON — An immigrant teen who was denied an abortion by a U.S. government official, even though her pregnancy was caused by rape, had threatened to harm herself if she was forced to have the child, according to a government memo released Friday.

The memo is addressed to Scott Lloyd, director of the Office of Refugee Resettlement, which shelters thousands of unaccompanied immigrant minors in the U.S. without legal permission. The American Civil Liberties Union posted the memo as part of its ongoing lawsuit over abortion access for immigrant minors in custody.

The administration of US President Donald Trump has said it bars abortions for refugee minors who were raped because it is in their “best interest”.

According to court documents in the case of a 17-year-old alleged rape victim in federal detention who tried to get an abortion, the head of the US Office of Refugee Resettlement (ORR) and noted anti-abortion activist E. Scott Lloyd said in a memo: "I am convinced that assisting with an abortion in this case is not in her best interest.”

Sheriff Joe Arpaio used to require pregnant inmates in the Arizona jails he controlled to get a court order before being allowed out of their cells to obtain a desired abortion. Needless to say, he was sued, and needless to say, he lost. (The sheriff appealed to the Supreme Court, which refused to hear the case.) So he switched tactics to require any inmate who wanted an abortion to prepay the transportation and security costs, something not required for any other off-site medical procedure. The American Civil Liberties Union took the sheriff back to court and won again.

That seemed to be that. Following President Trump’s pardon of Mr. Arpaio three months ago for an unrelated contempt of court conviction, the 85-year-old former sheriff, a right-wing hero for his years of abusing immigrants, seemed finally about to fade from the scene.

On Friday, the American Civil Liberties Union (ACLU) filed a second emergency action on behalf of Jane Doe, an unaccompanied immigrant minor being “held hostage” by the Office of Refugee Resettlement (ORR), after a district court on Wednesday denied a request for a temporary restraining order that would have allowed the teen to access an abortion.
