Do Americans Support Abortion? A New Poll Shows Stunning Results About Voters

As voters are preparing to head to the polls in November for the midterm elections, the fates of a handful of senators are tied up in the nomination of a new Supreme Court justice. The stance of Judge Brett Kavanaugh, President Donald Trump's nominee for the seat, on abortion in particular has caught the attention of voters, according to a new poll. The findings of the survey, released Monday, July 30, make it clear just how much Americans support abortion and indicate how this might play out in November.

The poll was conducted by Civis Analytics on behalf of the National Women's Law Center (NWLC) and the Planned Parenthood Action Fund (PPFA). The online survey, conducted on July 25, included responses from 2,438 likely voters, including Democrats, Republicans, and Independents.

On Monday, President Trump is expected to announce his nominee to replace Justice Anthony M. Kennedy on the Supreme Court. Given the president’s promise to appoint justices who would overturn Roe v. Wade, it’s widely understood that his nominee will pose a clear danger to women’s reproductive rights. What most don’t realize is that everyone’s personal-liberty rights are on the line.

The constitutional framework of Roe is about far more than abortion. It’s about rearing our children without unwarranted government interference. It’s about choosing whom we want to marry. It’s about deciding with whom we want to create a home. It’s about the right to use contraception. It’s about what the Supreme Court in Planned Parenthood v. Casey explained is the “promise of the Constitution that there is a realm of personal liberty which the government may not enter.”

America Will Lose More Than Abortion Rights If Roe v. Wade Is Overturned

In just a few years, scores of American women could lose their right to safe, legal abortion.

President Donald Trump can now choose a nominee to fill the Supreme Court seat of outgoing Justice Anthony Kennedy, a crucial defender of Roe v. Wade. Since being nominated to the Court by President Reagan in 1988, Kennedy served as an inconsistent but important bulwark against some of the court’s greater right-wing excesses. In 1992, when a case that could have overturned Roe v. Wade went to the Court, Kennedy signed on to a majority opinion upholding abortion rights. It became widely understood that he wouldn’t sign onto an opinion overturning Roe. He became a firewall — one that prompted anti-abortion activists to set about chipping away at access to abortion, instead of mounting a direct legal challenge.

Justice Anthony M. Kennedy announced Wednesday that he is retiring from the Supreme Court, a move that will give President Trump a chance to replace the pivotal justice and solidify a more conservative majority on the court that plays a crucial role in American life.

“It has been the greatest honor and privilege to serve our nation in the federal judiciary for 43 years, 30 of those years on the Supreme Court,” Kennedy, 81, said in a statement released in the afternoon of the last day of the term. He said his final day will be July 31.

Like many reproductive rights activists, I was horrified ― but sadly, not terribly surprised ― by the news that “moderate” swing vote Justice Anthony Kennedy is retiring from the Supreme Court.

Though he was often unreliable, Kennedy was the one slim ray of hope for a continuing federal right to a legal abortion now that conservatives control all three branches of the government. With his departure, Roe v. Wade, the 1973 ruling that made abortion legal in all 50 states, is critically endangered and careening toward extinction.

After the Supreme Court ruled 5-4 in NIFLA v. Becerra, NARAL Pro-Choice America President Ilyse Hogue issued the following statement:

“One vote: That’s the difference between ending the lies and deception at fake women’s health centers or letting them off the hook for their dangerous and deceptive practices. The deception at fake women’s health centers is real, but five Justices still refused to act on behalf of women who need accurate information to make the best decisions for our families and our lives. Today, the Supreme Court turned its back on women and condoned the deceptive tactics used by fake women’s health centers.
