USA – Unequal Justice: Did Five Supreme Court Justices Lie About Abortion?

In their auditions for the highest court in the land, each of them was at least materially misleading.

The Supreme Court’s landmark decision in Dobbs v. Jackson Women’s Health Organization, issued last year, overturned Roe v. Wade (1973) and Planned Parenthood v. Casey (1992), and dismantled the federal constitutional right to abortion. One of the lingering questions in the aftermath of Dobbs is whether any of the five justices who voted to take that drastic step lied about their views on abortion during their respective confirmation hearings before the Senate Judiciary Committee.

A strong argument can be made that each of them either lied or made materially misleading statements.

How Barrett’s confirmation could influence the fight over abortion access

Over her three-day confirmation hearing, Supreme Court nominee Amy Coney Barrett repeatedly declined to discuss her stance on abortion. But while there is no way to know for certain how she will rule on such cases, legal scholars say that her record, as well as a careful reading of certain answers she gave the Senate Judiciary Committee, gives clues about where the Supreme Court could be headed on issues of reproductive rights.

Barrett assured members of the committee that she would bring “no agenda” to her role if confirmed to the high court. She has also expressed anti-abortion beliefs in the past, and joined two dissents on abortion restriction cases during her time on the 7th Circuit Court of Appeals.

Washington (CNN)Supreme Court nominee Brett Kavanaugh on Wednesday described Roe v. Wade's right to abortion as settled -- "important precedent" -- yet he has also narrowly interpreted when a woman can exercise that right.

His past views, reinforced by testimony before the Senate Judiciary Committee, suggest Kavanaugh would permit government to impose stricter regulation of abortion, for example, with additional requirements that could delay the procedure or in stiffer rules for physicians who would perform it.

As the Senate Judiciary Committee proceeded with its confirmation hearing for President Donald Trump's Supreme Court nominee Brett Kavanaugh on Tuesday—whose appointment Planned Parenthood has said "would determine the health and freedom of countless women's lives"— it was women both inside and outside the hearing who led the charge against Kavanaugh's ascension to the highest court in the land.

NARAL Pro-Choice America shared that its Missouri and Washington chapters' executive directors, Alison Dreith and Tiffany Hankins, were among the more than 30 protesters who were arrested for demonstrating inside the hearing room.
