U.S. abortion restrictions absolutely do not align with European law

Three months after the Supreme Court’s decision to eliminate the constitutional right to abortion in the United States shocked people across Europe, Republican lawmakers have astonished Europeans again with claims that 47 of 50 European countries ban abortion after 15 weeks.

This is simply untrue — as is the claim, made by Sen. Lindsey O. Graham (R-S.C.) and other lawmakers, that by introducing a 15-week federal ban on most abortions, the United States would move into line with Europe.

Supreme Court nominee Amy Coney Barrett on Tuesday disputed assertions by Democrats that she would be a reliable vote to restrict health-care access and abortion rights, pledging during the second day of her confirmation hearing that she has no policy agenda while deflecting specifics about how she would rule.

Barrett came into her nomination with a lengthy public record that underscores a personal opposition to abortion and skepticism about legal reasonings that upheld the Affordable Care Act. She testified Tuesday that she believes Roe v. Wade, the 1973 decision that legalized abortion, is not among the “super precedents” of the Supreme Court that are considered so fundamental they cannot be overturned.

Justice Brett Kavanaugh’s ascent to the Supreme Court last year brought the future of abortion access into question. Lawmakers and activists on both sides of the debate saw his confirmation — and a shift to a conservative-leaning court — as a step toward overturning Roe v. Wade, the 1973 decision that legalized abortion in the U.S.

Ahead of Kavanaugh’s confirmation, Sen. Kirsten Gillibrand, a Democrat from New York, warned that the Supreme Court would “take away and criminalize women’s reproductive freedom.” Sen. Lindsey Graham, a Republican from South Carolina, laid out his hopes for Kavanaugh: “If there’s a case before him that challenges Roe v. Wade [I hope] that he would listen to both sides of the story, apply a test to overturn precedent.”

Senate Rejects Measure to Ban Abortion After 20 Weeks of Pregnancy

WASHINGTON — The Senate rejected a bill on Monday to ban most abortions after 20 weeks of pregnancy, a largely symbolic vote aimed at forcing vulnerable Democrats to take a stand that could hurt their prospects for re-election in states won by President Trump.

By a vote of 51 to 46, the measure fell well short of the 60-vote threshold required for the Senate to break a Democratic filibuster. The outcome was not a surprise, and the vote fell mostly along party lines.
