A federal judge is poised to restrict mifepristone – even though the drug has been safely and effectively used in the US for more than 20 years

This week a Republican-appointed federal judge weighed whether to grant an injunction that could remove mifepristone, the drug used in most American abortions, from the market nationwide. And the hearing almost happened in secret.

US district court judge Matthew Kacsmaryk had initially planned to keep Wednesday’s hearing in the case – in which a group of rightwing anti-abortion groups are suing the FDA to reverse its 20-year-old approval of mifepristone – quiet. In a conference call with lawyers for the anti-choice groups and the Department of Justice, Kacsmaryk asked attorneys not to disclose the existence of the hearing (“This is not a gag order,” he said repeatedly), and said that the event would only be made public late on Tuesday to minimize popular awareness. “It may even be after business hours.” The judge’s courtroom in Amarillo, Texas, is hours away from any major city. It was only because of a press leak that the hearing was known to the public at all.

The Texas Republican governor Greg Abbott has signed into law one of the most extreme six-week abortion bans in the US, despite strong opposition from the medical and legal communities, who warn the legislation could topple the state’s court system and already fragile reproductive healthcare network.

“This bill ensures that every unborn child who has a heartbeat will be saved from the ravages of abortion,” said Abbott, flanked by several members of the Texas legislature this morning.

Canada – Premier’s abortion-access comments feature in group’s lawsuit against the province

Civil liberties group wants to sue province on behalf of all New Brunswick residents

The Canadian Civil Liberties Association says it has the right to sue the New Brunswick government for lack of abortion access, partly because the premier made it a legal issue in his public comments.

On Monday, lawyers for the association and the province appeared before Chief Justice Tracey DeWare of the Court of Queen's Bench to argue whether the association has "public interest standing" to sue the province for what it sees as unconstitutional abortion laws.

In its first Trump-era abortion case, the Supreme Court will be considering a sneaky issue next week that could, without much fanfare, drastically curtail abortion rights litigation — and, ultimately, access to abortion. This issue has nothing to do with the constitutionality of abortion and everything to do with what the court thinks about abortion providers: Are they caring medical professionals, or are they craven opportunists?

In June Medical v. Russo, Louisiana is arguing that abortion providers don’t have the best interests of their patients in mind and therefore shouldn’t have standing to bring lawsuits on their behalf. That’s simply not true.
