It took five months for the Biden administration to make a substantive policy change to advance abortion rights. And even that change was buried in a 61-page regulation setting rules for 2022's Affordable Care Act enrollment.

The policy would reverse a Trump administration rule requiring insurers that cover abortion to send separate bills for that coverage. Abortion-rights opponents had hoped the extra paperwork would persuade insurers to stop offering the coverage.

The Supreme Court has been sitting on a potentially very significant abortion case for the last two months, one that the Court’s rules say it should dismiss. We’re likely to find out this week whether the Court will dismiss this case, however, and that decision could tell us a great deal about how fast the Court plans to move in rolling back abortion rights.

In February, about a month after President Joe Biden took office, the Supreme Court announced that it would hear three consolidated cases challenging a Trump administration policy targeting abortion clinics.

WASHINGTON — The Biden administration on Wednesday began to undo a Trump-era ban on clinics referring women for abortions, a policy that drove Planned Parenthood from the federal family planning program and created new complications for women trying to get birth control.

The proposed rule from the Department of Health and Human Services follows through on President Joe Biden's campaign promise to reverse his predecessor's family planning policy, which was branded a “gag rule” by women's groups and decried by medical associations as violating the doctor-patient relationship.

New rules proposed Wednesday would largely return the Title X program to its
pre-Trump formation, allowing more abortion clinics to participate in a program

President-elect Joe Biden is expected to roll back several of the Trump administration’s changes to sexual and reproductive health programs, undoing a large portion of the president’s executive actions on abortion and women’s health.

Abortion rights and women’s health care advocates anticipate the Biden administration will act swiftly to reverse a myriad of Trump-era rules including ones that allow more employers to opt out of ObamaCare’s contraception mandate and ban the use of federal family planning dollars for domestic and foreign organizations that provide or promote abortions.

AMA and Planned Parenthood ask Supreme Court to block federal abortion referral rule

(CNN)The American Medical Association, the main industry group for doctors, is asking the Supreme Court to block the Trump administration rule barring federally funded health care providers in the Title X family planning program from referring patients for abortions.

The petition filed Thursday comes as the high court faces a vacancy following the death of Justice Ruth Bader Ginsburg. But a contentious confirmation fight looms over President Donald Trump's pick for the seat, federal appeals court judge Amy Coney Barrett, who has expressed views and joined opinions that suggest she is receptive to further restrictions on abortion rights and would likely help further cement a conservative majority on the court.

In April 2019, when meetings like this still took place, Diane Foley took the stage in Indianapolis, looking out into the faces of anti-choice advocates and doctors who were gathered for their annual conference. The Health and Human Services official began her presentation: “Opportunities for Collaborative Engagement in Policy Development.” The bland, policy-wonkish title belied its almost-revolutionary substance: nothing less than a major shift in American health care—and a threat to the more than 4 million primarily low-income people who rely on a key government program for family planning and other care.

Title X, which Foley oversees as the head of the Office of Population Affairs—and which also includes the government’s teen pregnancy program—offers health care providers more than $286 million in funding each year. Just a month before her presentation, a new rule passed that would, for the first time, prohibit Title X recipients from performing abortions on-site or even providing abortion referrals. This effectively shut out a quarter of all clinics that were getting funding—including Planned Parenthood, which has traditionally received some $60 million a year from the program and provides more than 2.4 million patients with a slew of services, from birth control to cancer screenings to wellness exams.

The Trump administration and its political allies may be letting up on COVID-19 restrictions, but it’s still full speed ahead when it comes to their attacks on sexual and reproductive health and rights. They’re using every means at their disposal — legislative, regulatory, budgetary — to curb access to reproductive health services.

The U.S. Supreme Court recently heard oral arguments that could make it easier under the Affordable Care Act (ACA) for employers with moral or religious objections to opt out of providing free birth control coverage in their insurance plans.

Abortion access in America is hanging by a thread. On Wednesday, I sat in the US supreme court and listened to the case – June Medical Services v Russo – that could be the beginning of the end of Roe v Wade.

As the president of the Planned Parenthood Action Fund, it was my privilege to be one of the few listening in the court – but the reality is that this case will affect the rights and lives of millions.
