A 25-year-old woman in Nagpur used household utensils to self-abort last year by watching a YouTube tutorial. The procedure that involves a safe place, safe tools and a trained medical practitioner was carried out by herself, in her own home when her parents were away. The woman survived but she had to spend days in the hospital, recovering from an acute infection from the procedure that could have killed her. This is not the only story of a botched abortion.

The Medical Termination of Pregnancy (MTP) Amendment Bill 2020 is due to be discussed in an upcoming Rajya Sabha session. This is the second time, in its 49 years of existence, that the MTP Act will be amended. While introducing the Bill in the Lok Sabha, the Health Minister highlighted the government’s intent to improve access to safe, affordable and legal abortion services for women without compromising on safety, quality of care and more importantly to ensure dignity, autonomy, confidentiality and justice for women who need to terminate their pregnancies.

The Amendment Bill proposes some welcome changes-- it replaces the phrase “married woman and her husband” with “woman and her partner”; increases the upper gestation limit to 20-24 weeks for “certain categories of women”; reduces opinion required for termination of pregnancy between the 12th and 20th week of gestation from two providers to one and removes upper gestation limit for foetal abnormalities ‘necessitated by the diagnosis of a Medical Board.”

The coronavirus pandemic and the subsequent lockdown has adversely affected many communities and subsections of society especially the poor, migrant labourers, marginalised communities and women. Particularly, pregnant women, new mothers and women seeking abortions have been affected due to lack of resources during the lockdown.

The Ministry of Health in its note on providing essential healthcare services said, “Focusing on COVID-19 related activities, and continuing to provide essential services, is important not only to maintain people’s trust in the health system to deliver essential health services, but also to minimise an increase in morbidity and mortality from other health conditions.”

It took two weeks for a woman living in Bhiwandi in Maharashtra to get to an abortion clinic in South Mumbai after finding out she was pregnant. The journey usually takes about 2-3 hours.

After finding out she was pregnant, the woman got an appointment at the abortion clinic. But by the time she could arrange for a vehicle amid the lockdown, she had already crossed the seven-week limit to get a medical abortion and instead had to undergo a surgical one. "She was one of the lucky ones," a doctor who works at the hospital said.
