The new abortion rules notified by the Government recently recognise minors as a vulnerable category and seek to make services more accessible to them. But social stigma and conflict with POCSO Act, 2012, or the law against child sexual abuse, pose hurdles.

The Medical Termination of Pregnancy Amendment Rules, 2021, define new categories of vulnerable women who are allowed termination up to 24 weeks upon meeting certain conditions and with the permission of two doctors. These include minors, survivors of sexual assault and those with foetal malformation among others. Others may seek abortion up to 20 weeks with the permission of one doctor upon meeting certain criteria…

A pregnant silence on reproductive rights of women
The country needs to recognise the wrongs and affirm the rights for advancing women’s sexual and reproductive health

Young women (15-24 years) constitute 11 per cent of India’s population, out of whom 41 per cent have faced sexual violence, 27 per cent are married before the legal age and 7.8 per cent (15-19 years) become mothers or are pregnant. The data on access to information on contraceptives reveals that only 17.7 per cent were informed about family planning by health workers and just 6.9 per cent women in Bihar and 11.6 per cent in Uttar Pradesh (UP) reported using contraceptives within marriage.

The policy level commitments on health, education and gender parity often look in absolute terms of changing certain societal norms through cash transfer based schemes, number of girls reported to be married before the legal age of marriage, status of body mass index and nutrition and sometimes enrollment in school and skill development among women. While evidence in these parameters are significant, this skewed approach to gender equality leaves out a range of issues, including prevalence of sexual violence and status of accessible sexual and reproductive health services. Stigma and fear attached to young women’s sexuality act as a major barrier in achieving gender equality.

… since we published the photo above, taken during a protest against a case that has come back into the news this week. Along with human rights and women’s groups across Latin America in 2015, we joined the chorus of voices condemning the government and a hospital in Paraguay for refusing to allow a 10-year-old child who had been sexually abused by her stepfather to have an abortion. When the girl’s mother took her daughter to hospital suffering from stomach cramps and vomiting, she did not realise the girl was more than six months pregnant. et she was arrested and imprisoned for supposedly allowing the abuse to happen, and only after the girl had delivered was she released with all charges dropped.

The death of a 14-year-old rape victim who has died during childbirth in Paraguay has been in all the news media there. The girl had been hospitalised for 20 days, initially for a urinary tract infection, which was followed by other complications when she went into labour. Yet doctors were still attempting to deliver the baby vaginally until she suffered respiratory complications. They then attempted an emergency caesarean section, but the girl suffered an amniotic fluid embolism and three successive cardiac arrests and then she died.

The director of the National Hospital of Itauguá told local media: “It was very sudden. They attempted advanced resuscitation in intensive care, but could not save her. Her body was not ready for a pregnancy.” However, the girl’s family believe that her death was caused by medical negligence. They say the doctors insisted she give birth vaginally even though it was a high-risk pregnancy.

Turkish court rules for girl’s abortion, releases rape suspect

An 11-year-old pregnant girl has undergone abortion after a court ruling allowed her in the Central Anatolian province of Afyonkarahisar, Doğan News Agency reported on Dec. 13.

The girl turned out to be two and a half months pregnant when she complained of stomach ache after going to a public hospital on Nov. 7.

The hospital then reported the situation to the police.
