Camila’s body folds in on itself, eyes fixated on the cuffs of her sweater and thick black hair shielding her face. The 19-year-old, an Indigenous teenager from the Peruvian mountains, sits close to her lawyer, arms touching, in a small office overlooking Lima’s skyline. In clipped and hushed sentences, she begins her story.

At the age of 9, Camila was raped by her father. He ordered her not to tell anyone, threatening to kill her and her mother and brother if she did. For a while, his threats worked and she stayed silent. His vicious assault was the start of years of violence, abuse that would make Camila pregnant at the age of 13 and leave her ostracized from her community.

Abortion: a word that is guaranteed to spark a tense debate. Throughout the years, Malta has been nudged into considering its introduction but has held firm against. In 2013, the International Commission of Jurists told the UN that Malta’s blanket ban on abortion puts women at risk of torture and cruel, inhumane or degrading treatment. Nothing happened.

Three years later, the UNs Committee on the Rights of the Child recommended the decriminalisation of abortion “in all circumstances”, urging the government to ensure adolescent girls have “access to safe abortion and post-abortion care services”. Several international appeals persisted, including from the Council of Europe’s Commissioner for Human Rights. Nothing happened.

Human Rights Watch respectfully requests that the Honorable Inter-American Court of Human Rights accept us as Friends of the Court, so that we may submit for consideration this statement briefly summarizing Human Rights Watch research and legal analysis of children’s rights issues relevant to the case of Guzmán Albarracín vs. Ecuador.

The case before the court pertains to the sexual exploitation and abuse of Paola Guzmán Albarracín by state officials in the public school she attended. Guzmán Albarracín became pregnant after her school’s vice principal sexually abused her, following which he asked her to get an abortion in the school’s medical service. When she sought an abortion from the school’s doctor, he agreed to help her only if he had sex with him. Guzmán Albarracín died by suicide in 2002 at age 16.

Dear Secretary-General Guterres, international & national leaders,

We write to you as leaders of the United Nations and its agencies, and through our members to national leaders, to invite you to make a public statement from your own office/agency in support of International Safe Abortion Day, 28 September 2019. We also ask that the United Nations makes it an official UN Day.

International Safe Abortion Day has been celebrated since 1990, initially in Latin America. The date was chosen in commemoration of the abolition of slavery in Brazil. It was declared an international day in 2011. In 2012, events and activities took place in some 50 countries, rising within a few years to 60-65 countries across all continents. A growing number of national leaders and human rights bodies now recognise the day and speak out in support of its goals. Journalists are giving it more media space with every year that passes, drawing prominent national figures into the discussion.

Abortion is only permitted in Ireland where the life of the mother is in danger, making the Irish abortion framework one of the most restrictive in the world. This week, the Committee Against Torture questioned Ireland about its lack of progress in reforming Irish abortion law[1] and stated that it must explain its human rights obligations to the Irish public before any referendum on abortion.[2] This comes as little surprise as the Irish framework has previously been criticised extensively by four other international human rights committees.[3]
