The patients do not have to travel here to terminate their pregnancies, and they do not have to wait weeks to receive abortion medication from overseas.

Eighteen months after the Dobbs v. Jackson decision that overturned the constitutional right to abortion, and with a new Supreme Court challenge pending against the abortion medication mifepristone, confusion abounds about access to reproductive health care in America.

Since the June 2022 decision, abortion rates in states with restrictions have plummeted, and researchers estimated last month that the Dobbs decision led to “approximately 32,000 additional annual births resulting from bans.” Journalists profiled women who carried to term since Dobbs because they couldn’t afford to travel out of their restrictive state.

The most popular abortion method in the US could vanish from the market, leaving providers scrambling to find alternatives after the end of Roe v. Wade.

A Texas judge is expected to rule soon on a case seeking to remove the Food and Drug Administration’s decades-old approval of mifepristone, one of two pills commonly used together to terminate a pregnancy. The anti-abortion group behind the suit is arguing the FDA fast-tracked the drug’s authorization and lacked sufficient evidence to make its final decision.

Telehealth abortion providers eye new options for patients under loosened FDA rules

In the past year, there’s been a significant surge in interest in medication abortion via telehealth, after the Supreme Court overturned Roe v. Wade and the Food and Drug Administration made it possible for patients to get a prescription online and have the drug delivered to their front doors.

Now, telemedicine patients will have more pathways to care. A finalized rule from the FDA makes permanent the ability to distribute the medication by mail, while newly allowing retail pharmacies to distribute mifepristone, one of two drugs used to safely end an early pregnancy.

Some major pharmacies are planning to dispense abortion pills, but not in every state

After a change to US Food and Drug Administration rules, major pharmacy chains CVS and Walgreens say they plan to seek certification to distribute abortion pills where legally allowed.

The FDA said on its website Tuesday that pharmacies that become certified to dispense mifepristone, which may be used in a medication abortion, can do so directly to someone who has a prescription from a certified prescriber.

Doctors at online and brick and mortar primary care companies are slowly starting to prescribe medication abortion pills via telemedicine in states where it’s still legal following the Supreme Court’s Dobbs decision ending the constitutional right to the procedure.

The FDA has yet to update its rules to make way for large retail pharmacies to dispense medication abortion, limiting how patients can get pills. In the meantime, these companies are leaning on two mail-order pharmacies to fill their prescriptions.

Americans scramble for abortions in states that have banned it

Demand for pills that end pregnancy has skyrocketed in states that have restricted abortion since the Supreme Court decision last month, and abortion clinics are reporting a rush for appointments in towns bordering those states.

Aid Access, a virtual abortion clinic based in the Netherlands, saw a 256 percent increase in people coming to its site in the 24 hours after the court’s June 24 decision.

FDA Allows Telemedicine Abortion During Pandemic

Last Monday, the U.S. Food and Drug Administration (FDA) issued long-awaited guidance lifting a restriction on the abortion pill mifepristone for the duration of the COVID-19 public health emergency. The move permits telemedicine abortion, a combination of medication abortion—using pills to end a pregnancy—and telemedicine, which allows health providers to supervise the use of abortion pills via videoconferencing or telephone consultations.

Dr. Janet Woodcock, the acting FDA commissioner, wrote in a letter to the American College of Obstetricians and Gynecologists (ACOG) and the Society for Maternal-Fetal Medicine that the FDA will waive a requirement that clinicians dispense the abortion pill mifepristone to their patients in a clinic or hospital setting. The letter said research studies on telemedicine abortion “do not appear to show increases in serious safety concerns occurring with medical abortion as a result of modifying the in-person dispensing requirement during the COVID-19 pandemic.”

SCOTUS Issued a Blow to Abortion Pills by Mail, But Advocates Aren’t Giving Up

Reproductive justice activists are urging Biden to back access to abortion pills after a setback from the Supreme Court.

There has been a quiet revolution in access to abortion pills in the United States over the past six months — and whether it continues depends on the new Biden-Harris administration.

Last July, a federal court suspended a rule that requires patients to go to a health center in person to pick up mifepristone, the first pill in a two-step process for medication abortion. The court sided with SisterSong Women of Color Reproductive Justice Collective and the American College of Obstetricians and Gynecologists, allowing providers to mail mifepristone during the COVID-19 pandemic. But on January 12, the Supreme Court reinstated the rules, leaving in doubt the future of a landscape which advocates like Elisa Wells, co-founder of the medication abortion advocacy group Plan C, had rapidly begun to put in place.

U.S.-Based Online Pharmacy First to Ship Abortion Pills to Patients Inside the U.S.

For years, pharmacies outside the U.S. have been shipping abortion pills to American women wanting to end their pregnancies. But now, for the first time, a U.S.-based pharmacy—Honeybee Health—is distributing abortion pills directly to patients within the country by mail, now legal because of a recent federal court ruling.

“This is a momentous achievement for Americans, particularly for women of color and others who historically faced barriers to reproductive healthcare that are made even worse by COVID-19,” said Dr. Jessica Nouhavandi, co-founder, co-CEO and lead pharmacist of Honeybee Health.
