The Zombie Law Trump Wants to Use to Ban Abortion Nationwide

Donald Trump’s lawyer really, really hopes that Donald Trump doesn’t blow up their plan to ban abortion nationally by talking about it publicly before the election—at least according to the aforementioned Trump lawyer, speaking to The New York Times. Why Jonathan Mitchell, the conservative attorney from Texas, would boast in a national newspaper about a plan that he also supposedly hopes doesn’t become a campaign issue is unclear. Why he is using an open media channel to muse about what his client may or may not know is equally strange and confusing. But the headline here seems to be “Donald Trump backs a national abortion ban,” though possibly for reasons of which he’s yet to be apprised.

A Trump-Stacked Court Hopes to Limit Access to the Abortion Pill. The Final Decision Now Lies With SCOTUS.

The Fifth Circuit Court of Appeals released a decision on Wednesday, Aug. 16, that dismissed a challenge to the U.S. Food and Drug Administration’s 2000 approval of mifepristone, but would sharply restrict access to medication abortion nationwide and eliminate telemedicine abortion. The decision in Alliance for Hippocratic Medicine v. FDA remains on hold until final review by the U.S. Supreme Court.

“While the court has acknowledged that mifepristone—both brand and generic versions—can stay on the market, they are insisting we should roll back the clock to 2000 and put the medication under lock and key,” said Kirsten Moore, director of Expanding Medication Abortion Access Project (EMAA Project). “The extremist judges ignored the FDA, our basic rights, and more than 20 years of scientific evidence showing mifepristone is safe and effective, rolling back decades of advancement in the standard of care. This is a dangerous precedent for FDA’s scientific review authority.”

Appeals court says abortion pill mifepristone should remain on the market but rules in favor of limiting access

A federal appeals court on Wednesday wiped away a lower court’s ruling that would’ve taken the medication abortion drug mifepristone off the market, but upheld aspects of the ruling that could cut back access to the pills.

The ruling from a conservative three-judge panel of the 5th US Circuit Court of Appeals will not affect the current availability of mifepristone, as the Supreme Court has already said that the drug and regulations that make it accessible will remain in place for the time being.

Three GOP appointees, including 2 from Trump, will hear the next phase of major abortion pill case

The New Orleans-based appeals court panel that will oversee the next stage in the blockbuster legal challenge to the availability of medication abortion drugs is made up of three Republican appointees, including one Trump nominee who has called abortion a “moral tragedy.”

Circuit Judges James Ho and Cory Wilson, both Trump nominees, will hear the oral arguments on May 17, alongside Judge Jennifer Walker Elrod, an appointee of George W. Bush.

When the Supreme Court allowed Texas’s 6-week abortion ban to take effect on Sept. 1 — with three of Trump’s nominees in the five-justice majority — it was widely seen as the latest example of that bargain paying off for anti-abortion advocates.
