Abortion rights advocates say consequences dire if U.S. Supreme Court declines to hear pill case

More than a year after the U.S. Supreme Court decided states could set their own abortion laws, including bans, the nation’s highest court now could cut off abortion access in states where abortion is still legal.

The Supreme Court began its new term this week and has yet to announce whether it will hear Alliance for Hippocratic Medicine v. U.S. Food and Drug Administration, before the term ends in June 2024. This case was designed by the religious right to overturn the approval of the commonly used abortion drug mifepristone. But whatever the court does — even if it declines to hear the case — will further alter healthcare access in the U.S., reproductive health advocates said on a call to reporters Thursday.

In August, three judges on the U.S. Court of Appeals for the Fifth Circuit (which covers Texas, Louisiana and Mississippi) ruled that mifepristone—the most widely used abortifacient, and more commonly known as the abortion pill—could no longer be provided by mail. They imposed a new requirement that the medicine only be administered in the presence of a physician. They also limited the use of this drug to the first seven weeks of pregnancy, even though it is safe to use at least throughout the first 10 weeks.

The ruling did overturn a lower federal court edict from Judge Matthew Kacsmaryk—a Trump-appointed judge who failed to disclose to the U.S. Senate and the American people his recent anti-abortion writings—to revoke the FDA’s 23-year old approval of mifepristone as a safe drug for Americans seeking abortions.

NEW ORLEANS — Three federal judges seemed poised to rule against the Biden administration in its efforts to preserve access to the abortion drug mifepristone.

During an occasionally combative, two-hour hearing Wednesday before a panel of the 5th Circuit Court of Appeals, the judges — all Republican appointees — grilled attorneys from the Justice Departments and Danco Laboratories, the pill’s manufacturer, who are battling to keep the drug available in the U.S.
