People are understandably excited about statewide votes on abortion, but they could be gutted by a future Trump administration or by conservative judges.

There could be nearly a dozen constitutional amendments codifying the right to abortion on the ballot this fall—and some could even overturn active abortion bans, like in Florida, Missouri, and South Dakota.

But abortion ballot measures are not a magic fix: They don’t immediately undo bad laws, as evidenced by Ohio advocates having to file multiple lawsuits to challenge past restrictions, and they can’t bring back clinics that closed. And there’s one more vulnerability we’re not talking about: Pro-choice ballot measures aren’t safe from a future Trump administration, or the conservatives on the Supreme Court.

Ohio abortion rights ballot measure receives nearly double the needed signatures

COLUMBUS, Ohio (AP) — Groups hoping to enshrine abortion rights in Ohio’s constitution delivered nearly double the number of signatures needed to place an amendment on the fall statewide ballot, aiming to signal sweeping widespread support for an issue that still faces the threat of needing a significantly increased victory margin.

Ohioans United for Reproductive Rights said they dropped off more than 700,000 petition signatures on Wednesday to Republican Ohio Secretary of State Frank LaRose’s office in downtown Columbus. LaRose now will work with local election boards to determine that at least 413,446 are valid, which would get the proposal onto the Nov. 7 ballot.

If this is the year that Roe v. Wade fell, 2023 will be the year that kicks off what promises to be a years-long, state-by-state brawl between Americans who believe abortion is essential to freedom and Americans who believe the procedure is murder.

Come January, state legislatures across the country will open for business. Conservative lawmakers will try to narrow the last few avenues to abortion available in red states. Abortion rights activists, buoyed by their victories in the midterms, will push for more ballot measures. Many of these legislative and political showdowns will likely end up in the courts.

State-level Democratic officials and abortion-rights advocates are discouraged by how little their allies in Congress and the White House have done since a draft opinion overturning Roe v. Wade became public.

Instead of executive actions that could increase access to abortion pills or help protect people’s medical information, national Democrats have largely highlighted what they can’t do in the Senate and focused on fueling midterm-election turnout, angering state and local leaders who feel the burden to protect and expand access is falling almost entirely on their shoulders.
