USA – This Organization Took Out Pro-Abortion Newspaper Ads—in the Hometowns of the Justices Who Voted Down Roe

Last month marked the third anniversary of the Dobbs decision—the 2022 Supreme Court ruling that struck down Roe v. Wade, unraveling nearly 50 years of legal protection for abortion in the U.S. However, abortion is still an option—even in states with bans—thanks to medication abortion, which can be sent through the mail.

To celebrate the nationwide accessibility of abortion pills—even three years after Dobbs—Mayday Health took out a series of cheeky ads in the hometown newspapers of each of the five Supreme Court justices who struck down Roe v. Wade in 2022: Brett Kavanaugh, Neil Gorsuch, Amy Coney Barrett, Clarence Thomas and Samuel Alito.

So here's what happened. We—Mayday Health, an abortion education nonprofit—tried to buy a newspaper ad in The Times-Picayune of New Orleans. The ad featured just a few words: "Abortion pills are more popular than ever. Thanks, Amy" with a photo of Amy Coney Barrett, who was born in New Orleans.

The Times-Picayune of New Orleans, Louisiana said… no. They refused to publish. They sent us a rejection letter assuring us that they "support First Amendment free speech," of course. They just find our particular speech too "uncomfortable."

Uncomfortable.

Community Providers Have Given Abortion Pills to Over 70,000 People in Restrictive States Since Dobbs

In response to the Supreme Court overturning the constitutional right to abortion in June 2022 and many states banning and restricting abortion access, abortion advocates have created volunteer-run, donor-supported, community-based mutual aid groups around the country to provide free abortion pills to people living in states restricting abortion.

These community providers obtain medication from overseas suppliers, bring them into the country and mail them from within the United States so that people receive them promptly. Many of these groups—including AccessMA, FL Companion Request, Access Pills, Oklahoma Access and Territory Access, among others—serve people of all ages and gestational stages, using different protocols for people in later pregnancy.

The groups say they are increasingly confused and frustrated by how major technology platforms moderate posts about abortion services.

TikTok has briefly suspended the account of Hey Jane, a prominent telemedicine abortion service, four times without explanation. Instagram has suspended Mayday Health, a nonprofit that provides information about abortion pill access, without explanation as well. And the search engine Bing has erroneously flagged the website for Aid Access, a major seller of abortion pills online, as unsafe.

The groups and women’s health advocates say these examples, all from recent months, show why they are increasingly confused and frustrated by how major technology platforms moderate posts about abortion services.

Courtney, 27, learned about advance provision — a practice that involves ordering abortion pills as a precautionary measure — during a TikTok scroll. Once she found there were telehealth organizations safely shipping abortion pills to states with abortion bans, she sought her own supply. Living in Arkansas, where abortion is completely banned, paired with recently learning that she'd been taking a medication that had made her birth control ineffective, Courtney requested advance-provision pills through Aid Access, a nonprofit providing access to medication abortion by mail.

"If I ever was in the position of being pregnant and wanting to terminate, I would have the option to decide that for myself in the comfort of my home."

For years, right-wing evangelicals have posted billboards along highways and in towns across the U.S. trumpeting their religious views and their anti-abortion beliefs. Now, post-Dobbs, abortion rights supporters are fighting back with their own roadside billboards and mobile digital LED advertising trucks.

Shout Your Abortion recently posted six abortion rights billboards along interstate 55 through five states that have banned abortion—from Memphis, Tenn., to Carbondale, Ill. The billboards include messages like, “God’s Plan Includes Abortion” and “Abortion is Okay: You Know What’s Best for You.

Since the fall of Roe, there have been countless attempts to chill speech about abortion, and misinformation has run rampant. Just last month, a prominent newspaper published one of the most egregious examples yet: an op-ed by David Reardon titled “Coercive Abortions Are at the Heart of the FDA Abortion Pill Case.”

Reardon holds a degree from Pacific Western University, an unaccredited correspondence school that closed in 2006 after a lawsuit from the state of Hawaii. Medical professionals and researchers have repeatedly criticized his research for methodological flaws and biases—and reproductive health experts have argued that his conclusions are not supported by scientific evidence.

Denny spends many of their days sitting on their bed packing small pills into plastic ziplock bags, and then into brown envelopes, ready to be mailed out to people seeking abortion medications in states like Kentucky, Indiana and Ohio.

The pills are mifepristone and misoprostol—two medications that are the subject of intense political and legal debate. Every package of pills Denny mails out puts them in danger. But they won’t stop doing it.
