Idaho will attempt to defend its extreme abortion ban at the Supreme Court this Wednesday. Like many other abortion bans in the United States, the Idaho law contains a so-called life exception, which purports to allow an abortion when “necessary to prevent the death” of the pregnant person. But do these exceptions actually preserve the lives of patients in practice? As Mayron Hollis, Amanda Zurawski, the family of Yeniifer Alvarez-Estrada Glick, and countless other women can attest, the answer is no. And the truth is, they’re not designed to.

The day Mayron Hollis discovered she was pregnant in spring 2022 was the same day doctors gave her terrible news: The pregnancy could be fatal to both her and her fetus.

Hollis had given birth to another child earlier in the year through cesarean section, and doctors were concerned she would experience a cesarean scar pregnancy — a rare type of ectopic pregnancy in which a fertilized egg implants and develops in the cesarean scar. It can cause fatal internal bleeding.

USA – It’s Time to Call Abortion Bans What They Are—Torture and Cruelty

The US must learn from other countries where denials of abortion are considered intentional, state-inflicted torture and cruel, inhuman, or degrading treatment.

On August 24, 2022, Mayron Hollis sought an abortion after receiving news that her pregnancy was endangering her life and its continuation would likely result in uterine rupture and organ damage. Unfortunately, August 24 was also the day that Tennessee’s near-total ban on abortion went into effect. Denied care in her own state and unable to travel to one where she could get the care she needed, Hollis was forced to endure a dangerous pregnancy and birth, where she ultimately suffered severe hemorrhaging and lost her uterus, destroying her ability to give birth to any more children.

There are many terms to describe Mayron Hollis’s experience of being denied an abortion in Tennessee—harrowing, agonizing, unconscionable—but we should also call it what it is: torture and cruelty.

Tennessee woman gets emergency hysterectomy after doctors deny early abortion care

Mayron Hollis said she had just started taking contraceptives when she found out she was pregnant again a few months after giving birth in February 2022. Despite the surprise, Hollis and her husband say they were excited about the pregnancy and eager to add another child to their growing family.

Hollis, 32, had no idea the excitement would turn into a fight for her baby's life and her own.
