In Abortion Ban States, Women Get Second-Class Healthcare—Across All Specialties

Physicians across specialties, from oncology to dermatology, report that abortion bans are undermining patient care.

In the wake of the Dobbs decision, Physicians for Human Rights (PHR) issued a press release pinpointing with prescient accuracy that it would “trigger nothing short of a public health crisis, exacerbate existing health disparities, and further endanger already marginalized populations most.” The U.S. was now in “clear violation of international law and globally recognized health and human rights standards.”

In the years following Roe‘s overturn, PHR has issued state-specific research briefs on the harms of abortion bans. It has also worked to “empower clinicians and advocates to speak out against the human rights violations occurring under these draconian laws.”

When news that Lizelle Gonzalez was suing the local prosecutor’s office for more than $1 million in damages, after being falsely imprisoned for murder over an attempted self-managed abortion in 2022, reproductive rights advocates cheered the move as a pathway to justice for the wrongfully charged southern Texas woman. However, a revelation in the lawsuit gave them pause: At the same hospital that reported her self-induced abortion to authorities, Gonzalez underwent a “classical C-section” for the delivery of her stillborn child, instead of abortion care. Major invasive surgery, Cesarean sections carry much higher risk for health complications, like hemorrhaging, compared with D&E abortion, and can jeopardize subsequent pregnancies.

USA – It’s Time to Call Abortion Bans What They Are—Torture and Cruelty

The US must learn from other countries where denials of abortion are considered intentional, state-inflicted torture and cruel, inhuman, or degrading treatment.

On August 24, 2022, Mayron Hollis sought an abortion after receiving news that her pregnancy was endangering her life and its continuation would likely result in uterine rupture and organ damage. Unfortunately, August 24 was also the day that Tennessee’s near-total ban on abortion went into effect. Denied care in her own state and unable to travel to one where she could get the care she needed, Hollis was forced to endure a dangerous pregnancy and birth, where she ultimately suffered severe hemorrhaging and lost her uterus, destroying her ability to give birth to any more children.

There are many terms to describe Mayron Hollis’s experience of being denied an abortion in Tennessee—harrowing, agonizing, unconscionable—but we should also call it what it is: torture and cruelty.

The US Supreme Court’s decision to overturn the longstanding abortion ruling will have a chilling effect on reproductive healthcare provision in low income and middle income countries.

In 2018 a reproductive health organisation in Kenya found that anti-abortion advocates had put the address of its reproductive rights helpline on social media. “It was a veiled threat,” its programme manager, Mina Mwangi, tells The BMJ. “They wanted us to know that they knew how to get us.”

On 24 June 2022 the US Supreme Court overturned Roe v Wade, the landmark 1973 decision that protected women’s liberty to choose to have an abortion without excessive government restriction.1 Sexual and reproductive health rights organisations across the world, including Mwangi’s, feared the effects of the overturning in terms of funding and potential attacks. “We are heightening our security because of how emboldened the opposition are,” Mwangi says, adding that she dreads a potential withdrawal of funds from US non-governmental organisations: her organisation receives over 50% of its funding from US donors.

In Europe and the US, abortion rights are under renewed threat

(CNN)The Abortion Dream Team usually receives about 400 calls a month, from women seeking advice and information. Last week, the Polish advocacy group had 700 in the space of three days, according to team member Justyna Wydrzynska.

Some came from women who had just arrived at hospital to have abortions because of fetal defects -- only to be told to go home after Poland's highest court on October 22 imposed a near-total ban on abortion.
