The Council of Ministers in Spain is moving towards constitutional reform, with the aim of protecting abortion as a right. On Tuesday, April 7, this body approved in the second round the modification of Article 43 of the Constitution. Constitution. This change implies the addition of a fourth paragraph to guarantee equal access to abortion in all regions of the country.

In order to carry out the reform, it is necessary that the Popular Party vote in favor of it. Should the proposal go ahead, Spain would become the second nation in the world to include the abortion as a right in its constitution. The first was France in 2024.

Spain’s leftist government on Friday proposed anchoring the right to abortion in the constitution following a move by Madrid city hall to inform women about a supposed “post-abortion syndrome”.

The controversy erupted on Tuesday when Madrid city hall, controlled by the conservative Popular Party (PP) approved a far-right proposal to require medical services to notify women seeking abortions about this alleged syndrome.

The proposal claimed the syndrome could lead to alcohol and drug use, suicidal thoughts, and an increased risk of cancer.

MADRID – The Spanish government on Friday proposed a constitutional reform to protect abortion rights, amid a political row between Prime Minister Pedro Sánchez’s Socialist Party, the conservative Popular Party (PP) and far-right Vox over alleged misinformation promoted by Madrid’s PP-led city council.

“In a global context of attacks on sexual and reproductive rights, this step is needed to guarantee women’s freedom and autonomy,” government sources said. The initiative follows a PP–Vox-backed measure passed by Madrid PP-ruled city council obliging health centres to provide information on alleged “post-abortion trauma.”

Spain’s constitutional court rejects abortion law challenge

MADRID (AP) — Spain’s constitutional court on Thursday rejected a challenge lodged more than a decade ago by the conservative Popular Party against a law allowing abortions in the first 14 weeks of pregnancy.

The legal challenge had “not obtained the support” of the court, the verdict said. The main opposition PP’s legal argument had centered on the constitutionality of the right to life of the fetus.
