States pass laws allowing pregnancy centers to evade regulation and countersue for damages

States with and without abortion bans are advancing bills that would shield anti-abortion pregnancy resource centers from certain government mandates and attempts at regulation, allowing them to sue for damages if any part of the law is violated.

At least four states introduced the legislation this session, and two of them, Kansas and Wyoming, made it law. Montana also passed a similar law in 2025. The bills are still pending in Oklahoma and New Hampshire.

Two years after Roe’s overturn, there are more abortions in America — but they’re harder to get

Abortion has become more diffuse, thanks to the rise of telehealth and abortion pills. Both are under fire in the courts and state legislatures.

Two years after the Supreme Court overturned Roe v. Wade, the number of abortions performed in the country is up. But that’s only part of the story. In many places, they are also much harder to get or provide.

Clinicians nationwide provided more than a million abortions in 2023 – the highest in the country’s recorded history — in the first full year since Roe’s fall, according to the nonpartisan Guttmacher Institute. That’s the result of a dramatic change in how people get abortions: Rather than receiving clinic-based care in their home states, people are increasingly traveling across state lines, or going online to obtain drug prescriptions. Almost 200,000 people traveled to another state for an abortion. Data from the Society of Family Planning suggests that 1 in 5 are now done through telemedicine, in which a health care professional prescribes and mails abortion pills for a patient to take at home.

Advocates and some GOP lawmakers have started mobilizing around potential federal legislation to outlaw abortion after six weeks of pregnancy

Leading antiabortion groups and their allies in Congress have been meeting behind the scenes to plan a national strategy that would kick in if the Supreme Court rolls back abortion rights this summer, including a push for a strict nationwide ban on the procedure if Republicans retake power in Washington.

The effort, activists say, is designed to bring a fight that has been playing out largely in the courts and state legislatures to the national political stage — rallying conservatives around the issue in the midterms and pressuring potential 2024 GOP presidential candidates to take a stand.
