I remember the day I heard about Dobbs. It was a summer morning during my final year of medical school. I’d awakened in the damp basement apartment I’d rented for a clinical rotation in Pittsburgh. As I scrolled through my news feed, my heart plummeted. There was a resigned and tacitly understood melancholy among the women in the hospital that day. A sisterhood predicated on shared despair was quietly forming during the upheaval of perceived judicial betrayal. Even those of us who barely knew each other might wearily exchange passing glances in the hallway, signaling, “Well, shit. Girl, I know. And it’ll only get worse.”

No woman may escape the cruelty of the nebulous and varying restrictions on reproductive healthcare in the post-Roe world—as Rep. Kat Cammack (R-Fla.) discovered in May 2024 when faced with a life-threatening ectopic pregnancy shortly after Florida’s six-week abortion ban took effect.

Sitting at her computer one day in late December, Dr. Sarah Osmundson mustered her best argument to approve an abortion for a suffering patient.

The woman was 14 weeks pregnant when she learned her fetus was developing without a skull. This increased the likelihood of a severe buildup of amniotic fluid, which could cause her uterus to rupture and possibly kill her. Osmundson, a maternal-fetal medicine specialist at Vanderbilt University Medical Center who helps patients navigate high-risk pregnancies, knew that outcome was uncommon, but she had seen it happen.

The first physician to publicly fall victim to the antiabortion madness that has followed the overturning of Roe vs. Wade was vindicated last month when Indiana medical officials ruled that she did not fail to report child abuse and was not unfit to practice medicine after providing abortion care to a 10-year-old and telling a reporter about it.

Ludicrously, though, the state medical board fined Dr. Caitlin Bernard $3,000 for violating her unnamed patient’s privacy rights. The board members' ruling, as it’s been reported, didn’t make clear exactly what protected information she had disclosed.

Hundreds of Indiana doctors are coming to the defense of Caitlin Bernard, the obstetrician/gynecologist who was recently punished by a state licensing board for talking publicly about providing an abortion for a 10-year-old rape victim.

In public statements, doctors across a range of specialties are speaking out against the board's decision, and warning that it could have dangerous implications for public health.

Weeks after Roe v. Wade was overturned, Dr. Caitlin Bernard made national headlines when she disclosed that she had provided an abortion to a 10-year-old girl who had been raped. That attention landed Bernard in the middle of an investigation by Indiana Attorney General Todd Rokita into whether she properly documented the abortion and if she violated privacy laws. Now a judge will decide whether Rokita can seek other patients’ medical records as part of the investigation.

Monday night concluded the second part of an emergency hearing scheduled to determine whether Bernard will be granted a preliminary injunction to block Rokita from continuing to subpoena medical records from Bernard and her medical partner as part of his ongoing investigation into her. Rokita’s investigation continues even after Bernard proved that she had properly documented the abortion and that she had not violated patient privacy laws when she told reporters about the 10-year-old.

Tattooed on Caitlin Bernard’s left foot is the image of a coat hanger and the words “Trust Women.” The 38-year-old Indiana-based ob-gyn got it years ago; it was intended as a reminder of life before Roe v. Wade. Bernard has long paired her medical career with advocacy. She was a plaintiff in an unsuccessful 2019 American Civil Liberties Union lawsuit to reverse Indiana’s near-total ban on second-trimester abortions. Post-Roe, Indiana became the first state to pass an abortion ban. Now, Bernard is girding for another legal fight—this time against Republican Indiana attorney general Todd Rokita, who she says maligned her practice as Bernard became a lightning rod in one of the most publicized cases after the Dobbs decision stripped federal abortion protections and turned the country into a patchwork of disparate laws.

An Indiana doctor speaks out on abortion, and pays a price

Wade, Dr. Caitlin Bernard, an Indianapolis obstetrician-gynecologist, donned her white lab coat, put her infant daughter into a front-pack baby carrier and joined a few colleagues who marched to the state Capitol, hoping to deliver a letter to Gov. Eric Holcomb. Signed by hundreds of health professionals, the letter implored Holcomb, a Republican, not to convene a special legislative session to further restrict abortions. It contained a pointed political message: “Abortion bans are not popular in our state.”

The lawyer for a doctor who provided abortion services to a 10-year-old rape victim sent Indiana Attorney General Todd Rokita a cease-and-desist letter Friday demanding he stop making "false or misleading statements" about the physician.

The letter comes after a Fox News interview Wednesday where Rokita said he was investigating Dr. Caitlin Bernard, who made international headlines earlier this month when she told The Indianapolis Star that she treated a 10-year-old rape victim who couldn’t get an abortion in her home state of Ohio because of a “fetal heartbeat“ law. The state law, which was enacted after the U.S. Supreme Court overturned Roe v. Wade last month, outlaws abortions at around the sixth week of pregnancy. Bernard said the girl was just over six weeks pregnant.

INDIANAPOLIS -- A federal judge ruled Tuesday that several of Indiana’s laws restricting abortion are unconstitutional, including the state’s ban on telemedicine consultations between doctors and women seeking abortions.

The judge’s ruling also upheld other state abortion limits that were challenged in a broad lawsuit filed by Virginia-based Whole Woman’s Health Alliance in 2018 as it fought the denial of a license to open an abortion clinic in South Bend.
