USA – Kavanaugh Is the Last Hope for Abortion Rights

Liberals have reviled the conservative Supreme Court justice since his confirmation hearing, but now hope that he still cherishes the reputation for moderation that he cultivated.

For the first time in 30 years — a legal generation — the Supreme Court is poised to revisit the law of abortion rights in a fundamental way.

The last time, in 1992, amid expectations
that Roe v. Wade might be reversed, the right to choose was saved by an
unlikely coalition: Justices Anthony Kennedy and Sandra Day O’Connor, both
President Ronald Reagan’s nominees, and David Souter, nominated by President
George H.W. Bush, wrote a joint opinion in Planned Parenthood v. Casey that
preserved the essential holding of Roe, which had made abortion a
constitutional right in 1973.

“President Trump has vowed to nominate to the U.S. Supreme Court only justices who will overturn Roe v. Wade. In addition to this litmus test, he has also said women who have abortions should be punished. Today, with the nomination of Judge Kavanaugh, the President is presumably making good on his Roe-reversal promise. Every Senator should assume that is the case, absent a clear and compelling statement from the nominee that he agrees with the rationale and premise of Roe v. Wade—that the right to abortion is among the Constitution’s guaranteed personal liberty rights.

“In the past twelve years that Judge Kavanaugh has served on the U.S. Court of Appeals for the D.C. Circuit, he has ruled in one case involving women’s access to abortion.
