USA – No One’s Access to Abortion Is Guaranteed — No Matter Where You Live

Living in a “blue state” does not guarantee the availability of abortion care to everyone who needs it.

Last year, travelers to the Oakland airport were greeted by a billboard touting the availability of abortion in California paid for by Gov. Gavin Newsom. The billboard was one of many in a 2022 campaign highlighting the state government’s new website for people seeking abortions, with the majority of billboards erected on California’s dime in states that had banned abortion following the U.S. Supreme Court’s decision to overturn Roe v. Wade and Planned Parenthood v. Casey. Some of the billboards, like one in Texas, featured an image of a white woman wearing a white dress in handcuffs beside the words, “Texas doesn’t own your body. You do.” (The irony is that California does prosecute women for stillbirth and other pregnancy outcomes.)

On May 20, 18-year-old Alyssa Roberts drove to a CVS store in Mobile, Alabama, and bought a pregnancy test. Roberts, who asked to use a pseudonym for her last name to protect her identity, kept her best friend on the phone while she anxiously took the test and waited. A few minutes later, she discovered she was pregnant.

Roberts gave herself a week to think through her options, but it only took her two days to realize she wasn’t ready for a baby. That’s when she started looking for an abortion clinic.

Nancy Davis found herself living what she called “a mother’s worst nightmare.” Around ten weeks into her pregnancy, an ultrasound detected that the fetus had acrania, meaning it was developing without a skull. Davis lives in Louisiana, and acrania doesn’t appear on the list of “medically futile” conditions that allow for an exception to the near-total abortion ban the state implemented after the Supreme Court overturned Roe v. Wade.

“Louisiana doctors, they were scared of prosecution; they were scared of being fined,” Davis says. “So I went somewhere the laws were clear and they were confident they could give me the care that I needed.”

When I realized I needed an abortion, I didn’t realize that it would be a destination abortion. I didn’t realize how many barriers—how many people—would be in my way just so I could get the abortion I wanted, when I wanted it.

But thankfully, with the help of complete strangers, I was able to get the abortion I wanted at 30 weeks.

What would life be like without Roe v. Wade, the landmark 1973 ruling that gave women in the U.S. the right to a legal abortion? This has become a common question ever since President Donald Trump nominated federal judge Brett Kavanaugh last month to replace the just-retired justice Anthony Kennedy on the Supreme Court, with anti-abortion activists gearing up for a post-Roe world and defenders of abortion rights warning that if confirmed by the Senate next month, Kavanaugh could be the deciding vote to re-criminalize abortion.

If that were to happen, the United States would revert to a patchwork of local laws; only eight states — Maine, Connecticut, Delaware, Maryland, California, Nevada, Washington, and Hawaii — have laws that guarantee the right to abortion, while others have legislation in place that would immediately ban it.
