After a Month of Obstruction by the Trump Administration, Jane Doe Gets Her Abortion

WASHINGTON — More than a month after she made her decision, Jane Doe was able to obtain an abortion this morning. She was able to get the abortion care after an appeals court in Washington, D.C., issued a decision late yesterday, clearing the way for a federal district court to issue an order requiring the Trump Administration to stop blocking her access and to allow her to get the care she requested.

Federal court clears way for immigrant teen to get abortion

WASHINGTON — A federal appeals court on Tuesday cleared the way for a 17-year-old immigrant held in custody in Texas to obtain an abortion.

The full U.S. Court of Appeals for the District of Columbia Circuit ruled 6-3 that new dates should be set for the teen to obtain the procedure. The ruling overruled a decision by a three-judge panel of the court that at least temporarily blocked her from getting an abortion. The Trump administration could still appeal Tuesday’s decision to the Supreme Court.

A US appeals court on Friday prevented an illegal immigrant teenager detained by the government from immediately obtaining an abortion, although it left open the possibility she could undergo the procedure within days.

The decision by a US court of appeals for the District of Columbia circuit panel gave the government until 31 October to approve a sponsor, who could help the 17-year-old obtain the procedure without the government’s assistance.

Jane Doe is a 17-year-old undocumented immigrant detained in Texas who is 15 weeks pregnant and is seeking an abortion. The Constitution grants her that right, but the Trump administration is determined to subvert it as part of its war on women’s reproductive rights.

Late Friday, a federal appeals court in Washington ruled that the teenager must be allowed to have an abortion, but it gave the federal government until Oct. 31 to find her a sponsor so that the government itself does not have to arrange for the procedure. The ruling came hours after the court heard the case, in which the Department of Health and Human Services’ Office of Refugee Resettlement said that if it released her to see a doctor it would “facilitate” an abortion, an action it said would contradict its interest in “promoting child birth and fetal life.” The government argued that barring an abortion doesn’t place an “undue burden” on her rights because she can always go home to get one — to a Central American country that criminalizes abortion and to parents who are abusive.
