Claims ministers ‘duped’ voters in Eighth referendum rejected

Government ministers do not have to meet standards of “legal accuracy” when campaigning in referendums and only an extreme situation might entitle the courts to intervene in their campaigning, the State has told the High Court.

No such situation arose concerning how Taoiseach Leo Varadkar and Minister for Health Simon Harris campaigned in favour of repealing the anti-abortion Eighth amendment, Frank Callanan SC said.

A man seeking leave to challenge the result of the abortion referendum has claimed the Taoiseach and Minister for Health had made “misleading” statements which “duped” some people into voting Yes and “materially affected” the outcome.

Charles Byrne claims Taoiseach Leo Varadkar and Minister for Health Simon Harris were not permitted under the Constitution to advocate for a Yes vote and made statements which impermissibly interfered with the conduct of the referendum.

A man seeking leave to challenge the result of last month’s abortion referendum will formally apply this week for court orders requiring the State to provide him with the original and supplemental electoral registers of voters, including the dates of birth of voters.

Charles Byrne, of College Rise, Drogheda, Co Louth, also wants marked registers of all those who voted on May 25 so the material can be analysed by a public administration expert, his counsel Kenneth Fogarty SC said

The president of the High Court has fixed June 26th for hearing three separate applications for permission to challenge the result of the referendum on the Eighth Amendment.

One of the challengers, Charles Byrne, who has raised concerns about whether a number of student voters at NUI Galway were properly registered, also wants copies of the marked register of voters.

Potential legal challenges to the result of the referendum on the Eighth Amendment to the Constitution will not delay the passage of legislation to give effect to Ireland’s new abortion regime, Government sources say.

Three separate applications have been initiated seeking permission to bring petitions challenging the result of last month’s referendum. It saw a landslide vote of 66.4 per cent in favour of repealing the Eighth Amendment.

Three court challenges initiated to abortion referendum result

Three separate applications have been initiated seeking permission to bring petitions challenging the result of the referendum to repeal the Eighth amendment.

All three have been adjourned to Monday when they will come before the president of the High Court, Mr Justice Peter Kelly.
