Washington, DC – For decades, the conservative right in the United States has been campaigning to overturn the landmark 1973 Supreme Court ruling in Roe v Wade, which affirms a woman’s right to have an abortion.

The movement, embraced by the Republican Party and fuelled by evangelical Christians, has pushed to elect conservative legislators at the state and federal levels, and advanced the placement of conservative justices on the US Supreme Court. Now, the anti-abortion rights forces in the US are on the verge of a significant legal victory.

Yet no matter how the current conservative-dominated court handles pending high-profile abortion cases -- perhaps weakening Roe, perhaps gutting it completely -- there will be no monolithic, nationwide change. Fractious state-by-state battles over abortion access will continue.

Standing on the lawn of the US Capitol, in clear view of the supreme court, a coalition of Democratic women declared Roe v Wade was no longer the law of the land.

Nearly half a century after the court established the constitutional right to abortion, it allowed a near-complete ban to stand in Texas, the second-most populous state. Though the 5-4 decision did not address the substance of the Texas law, Democrats warn that it was a mere taste of things to come from the court – and Republicans who helped expand its conservative majority.

Now, the White House is insisting there is no such abortion litmus test for Ruth Bader Ginsburg’s replacement. The change in tone reflects the tightrope Trump is currently walking on abortion with conservatives — and especially religious conservatives — ahead of the November election. Trump needs to both nod to concerns of powerful religious groups that have spent years trying to overturn Roe, the 1973 Supreme Court decision that cemented legal abortion, while not turning off the sizable faction of more moderate religious voters and Republicans who support legal abortion.

It would be difficult to overstate the significance of this year’s elections for the future of abortion in America. The results could eventually determine whether Roe v. Wade is overturned by the Supreme Court or codified by Congress.

Normally, stakes that high would make abortion a primary focus of the 2020 campaign. But normally, the country wouldn’t be experiencing a pandemic, a recession and a civil rights movement all at once. On Night 1 of the Democratic National Convention, the sum total of the attention abortion received was the second it took Kamala Harris to say “reproductive justice” in a video montage.

FAIRVIEW HEIGHTS, Ill. — When it opens just across the river from St. Louis this week, the new Planned Parenthood clinic in Illinois will be one of the largest abortion clinics in the Midwest, set up to serve around 11,000 women a year with various health services, double the capacity of the clinic it is replacing.

Its size says as much about the future as the present: With the Supreme Court’s shift to the right, activists on both sides of the abortion divide are adjusting their strategy, anticipating that Roe v. Wade, the 1973 Supreme Court decision that extended federal protections to abortion, might eventually be overturned and that some states would jump at the chance to ban abortions.

Anti-abortion groups — normally staunch allies of the Trump administration — have turned their fire on the health department, accusing the agency of being complicit in abortions by refusing to end research projects using fetal tissue.

The simmering fight spilled into public view on Monday night, as HHS abruptly terminated one longstanding contract with a fetal tissue provider while opening an audit of all federally funded research and practices related to fetal tissue, which is mostly obtained from abortions.
