After fall of Roe, emboldened religious conservatives lobby to restrict abortion in Africa

NAIROBI, Kenya (AP) — Nowhere in the world has a higher rate of unsafe abortions or unintended pregnancies than sub-Saharan Africa, where women often face scorn for becoming pregnant before marriage.

Efforts to legalize and make abortions safer in Africa were shaken when the U.S. Supreme Court ended the national right to an abortion a year ago. Within days, Sierra Leone President Julius Maada Bio declared that his government would decriminalize abortion “at a time when sexual and reproductive health rights for women are being either overturned or threatened.”

Period tracking apps, car licence plate data and pregnancy registers are the latest tools activists warn are being harnessed to stop women using legal or geographic loopholes for terminations. All four countries have reversed abortion rights over the past two years.

The past decades have brought modest improvements to women’s reproductive health around the world. Over the last 30 years, global rates of unintended pregnancies have thankfully declined by almost 20 percent, presumably in part because of better access to education and contraceptives. In 1973, the US Supreme Court, ruling in Roe v. Wade, declared an American woman’s right to an abortion to be fundamental and constitutionally protected. This landmark decision helped inspire many countries around the world to enshrine the individual right to bodily autonomy in law or expand access to abortion services — including Canada and India. Many women have been able to access safe abortions and post-abortion care.

Then the 2022 US Supreme Court overturned Roe v. Wade.

In 1973, soon after the US Supreme Court established a right to abortion in Roe v. Wade, Charles E. Rice concluded that “the essential remedy to the abortion problem is a constitutional amendment.” Rice is an important figure in the intellectual history of the antiabortion movement that is now, with the recent overturning of Roe, enjoying its moment of triumph. He was a cofounder of the Conservative Party of New York State, formed by those who considered the Republican Party too liberal; one of his scholarly tracts is an attack on the Voting Rights Act of 1965. As a professor of constitutional law, he established Notre Dame University in Indiana as a redoubt of the conservative Catholic legal thinking whose influence most fully blossomed when Donald Trump appointed Rice’s colleague and associate Amy Coney Barrett to the Supreme Court.

A Catholic group in Malawi used money from the US to support its campaign against a bill to allow legal abortion in cases of rape – after condemning proposed reforms as an imposition of “foreign cultures”.

The Episcopal Conference of Malawi (ECM), a local assembly of Catholic bishops, received a $30,000 grant from the US Conference of Catholic Bishops (USCCB) in 2019 for “pastoral animation and advocacy of members of parliament and the laity in political leadership”.

Chile’s feminists push to decriminalize abortion

Abortion campaigners in Chile have been heartened by the recent legalization of abortion in neighboring Argentina and are currently presenting a bill for the decriminalization of abortion. But with a pro-life government and Senate inherited from the Pinochet regime (1973-90) any amendments to the existing law will be hard won.

Chile has one of the world’s most draconian abortion laws in the world. Dictator General Augusto Pinochet’s last act before leaving office in 1989 was to completely outlaw abortion and make it a punishable crime. It was not until 2017 that President Michelle Bachelet’s administration was able to amend the law to allow abortion in extreme cases. But women’s reproductive rights have come under attack again by far-right President Sebastian Pinera’s cabinet. In 2019 Pinera introduced an amendment allowing entire (private) hospitals and medical professionals to object to the procedure on grounds of “conscience.”
