India – 55-year-old rapist, nurse who performed abortion on minor held under Pocso Act in TN

According to a police source, the accused farmer of Ponnivadi village in Dharapuram owned several acres of farmland in the locality.

TIRUPPUR: Police on Friday arrested a 55-year-old man under Pocso Act for sexually assaulting a girl and making the minor abort the baby in Dharapuram. A nurse attached to the Dharapuram Government Hospital was also arrested for her role in the Dalit girl’s abortion.

According to a police source, the accused farmer of Ponnivadi village in Dharapuram owned several acres of farmland in the locality. The 16-year-old girl was working as a farmhand in his field. The accused sexually assaulted her repeatedly, and three months ago, the minor became pregnant.

The new abortion rules notified by the Government recently recognise minors as a vulnerable category and seek to make services more accessible to them. But social stigma and conflict with POCSO Act, 2012, or the law against child sexual abuse, pose hurdles.

The Medical Termination of Pregnancy Amendment Rules, 2021, define new categories of vulnerable women who are allowed termination up to 24 weeks upon meeting certain conditions and with the permission of two doctors. These include minors, survivors of sexual assault and those with foetal malformation among others. Others may seek abortion up to 20 weeks with the permission of one doctor upon meeting certain criteria…

India – 15-Year-Old Rape Survivor Dies of Pregnancy-Related Complications

The girl's family had come to know about her pregnancy only on December 6, 2020, when she was six-months pregnant. She was denied permission to abort.

New Delhi: A 15-year-old rape survivor died of pregnancy-related complications at the district hospital in Uttar Pradesh’s Bareilly district on Thursday. The girl was seven months pregnant.

According to news agency PTI, police revealed on Sunday that she was admitted to the hospital on the night of January 2 and passed away on the night of January 7.

A 59-year-old doctor was arrested on Saturday, July 18, for allegedly dumping a foetus at a garbage site in Maninagar area of Ahmedabad after conducting abortion of a 15-year-old girl.

The accused doctor, identified as Dr Chetan Shah has been reportedly running 'Keval Medicare Centre' hospital in the city's Vatva GIDC area for the last 29 years.

On 22nd May 2020, out of barely 30 cases enlisted on the daily board of Bombay High Court, 4 cases were for medical termination of pregnancy. One such case was of a 13-year old minor girl who was 22-weeks pregnant. The petition was filed through the girl's mother, a pavement dweller living in Thane. The girl in the case is a survivor of heinous rape alleged to have been committed by her own father. It has been reported that the father used to regularly abuse the girl, she then moved to south Mumbai to live with her aunt and stayed with her during the lockdown.

On 14th May, the girl told her aunt about the assault, after which she fell ill and was taken to the hospital. She was later diagnosed to be 22 weeks pregnant. When she went with her aunt to file the FIR at Crawford Police Station they wrongly refused to lodge her complaint and directed her to go to Thane Police Station. This was not an easy task as the entire country was in lockdown due to COVID-19. After they finally managed to lodged the FIR at the Thane Police Station under various sections of IPC and POCSO she was taken to taken to a JJ Hospital for an abortion. As she was already beyond the 20 week limit stipulated in the law, her family was informed that their only recourse was to get a judicial order from the High Court. The family which has a tough time making ends meet and without any source of income due to the Pandemic were made to run from pillar to post to find a lawyer who could help them out pro bono as they could never afford the fees for filing a Writ Petition in the High Court.

Explained: Why it is important to amend Medical Termination of Pregnancy (MTP) Act, 1971?

Moving to ease abortion laws in the country, the Union Cabinet is likely to approve changes in the Medical Termination of Pregnancy (MTP) Act, 1971. The draft has been circulated by the ministry of health and family welfare.

According to the 2014 draft bill, the upper limit for termination of a pregnancy will be extended from 20 weeks to 24 weeks. This will help in decreasing maternal morbidity and mortality and may also help in preventing wastage of resources invested in a pregnancy and preserving the woman's health, strength, and above all, life.
