Reporting Rape Survivors to Police Can Endanger Their Health

Brazilian authorities should revoke a Health Ministry regulation that erects
new barriers to legal abortion access, Human Rights Watch said today.

Among other measures in the August 27, 2020 regulation that could discourage
women and girls from accessing legal abortion, it requires medical personnel to
report to the police anyone who seeks legal termination of a pregnancy after
rape, regardless of the rape survivor’s wishes. The Ministry of Family, Women,
and Human Rights has also announced it will create a hotline for medical
personnel that could be used to report women and girls whom they suspect had an
illegal abortion.

The Bombay high court on Friday permitted a 16-year-old rape survivor to undergo medical termination of her 24-and-half-week pregnancy after her father filed a petition.

The HC said, “In view of her history and the fact that teenage pregnancy carries a risk of higher mental and physical morbidity and mortality, medical termination of pregnancy has been recommended by the medical board.” The order was passed via a videoconference hearing. The plea had sought urgent orders during the ongoing lockdown and the state and centre supported its urgency. The girl was 23-weeks pregnant then.

An 11-year-old Argentinian girl who was raped while in her grandmother’s care had a C-section earlier this week after doctors refused to give her an abortion, sparking a debate about choice in the South American country.

The girl became pregnant after her grandmother’s 65-year-old partner sexually abused her, according to local media reports. She had been in her grandmother’s care because her two older sisters had been abused by their mother’s partner, the Guardian reports.

An 11-year old girl who became pregnant after being raped was forced to give birth after Argentine authorities refused to allow her the abortion to which she was entitled.

The authorities ignored repeated requests for an abortion from the child, called “Lucía” to protect her identity, as well as her mother and a number of Argentine women’s right activists. After 23 weeks of pregnancy, she had to undergo a caesarean section on Tuesday. The baby is unlikely to survive.

A Salvadoran rape survivor accused of attempting to abort her abuser's baby was released on Monday after a judge found her not guilty on reduced charges in a case that tested the country's strict enforcement of a total ban on abortion.

Twenty-year-old Imelda Cortez became pregnant in 2016 after years of being raped by her 70-year-old stepfather. In April 2017, she gave birth to a baby girl in the toilet. At the time, she did not know she was pregnant, Cortez said. When she went to the hospital, a doctor accused her attempting to have an abortion and reported her to authorities.

This outrage stems from the prosecution of a 20-year-old Salvadoran woman, Imelda Cortez, who was charged with attempted murder after giving birth to her rapist's child. The rapist is the woman's stepfather, who, according to the Citizen Group for the Depenalisation of Abortion (via Aljazeera), has been charged with aggravated sexual assault of a minor.

In a case that highlights the rigidity of the country’s abortion laws, Imelda Cortez, 20, from an impoverished rural family in San Miguel, has been in custody since April 2017 after giving birth to a baby girl fathered by her abusive elderly stepfather.
