Another Risk in Overturning Roe

The decision rejects the idea of fetal personhood—which anti-abortion groups have been pushing on state legislatures.

January 22nd marked the forty-ninth anniversary of Roe v. Wade—and, likely, the last year that its protections will remain standing. In December, during oral arguments, the Supreme Court’s six conservative Justices signalled their intention to uphold a Mississippi law that, in banning almost all abortions after fifteen weeks of pregnancy, defies Roe’s protections. Most of those Justices seemed prepared to overturn Roe entirely. Without Roe, which prohibits states from banning abortion before fetal viability—at twenty-eight weeks when the law was decided, and closer to twenty-two weeks now—abortion could become mostly inaccessible and illegal in at least twenty states.

SAN SALVADOR, El Salvador — A young woman who gave birth to a baby in an outhouse toilet in El Salvador was back in court Monday facing a second trial for murder in a case that has drawninternational attention because of the country’s highly restrictive abortion laws.

Evelyn Beatriz Hernandez, who says she is a rape victim and had no idea she was pregnant, had already served 33 months of her 30-year sentence when the Supreme Court overturned the ruling against her in February and ordered a new trial, with a new judge.

Legislatures around the United States have passed increasingly tight restrictions on abortion in the past few years. As the overturning of Roe v. Wade becomes a more realistic possibility, some activists have looked to those in other countries with abortion bans for guidance.

In El Salvador, where abortion has been banned in all circumstances since 1998, activists drew similarities between the two countries’ situations—and told Rewire.News that those concerned about reproductive rights should look to unite with allies beyond their own borders.

For many people, the phrase “illegal abortion” calls to mind images of back alley clinics, medical providers with questionable credentials, and, of course, the dreaded coat hanger — an object so evocative it’s often been used as a protest symbol. But those images are outdated, belonging to a pre-Roe era. These days, the real action in abortion is now online, as a group of reproductive rights activists use the internet to spread the word about how to use abortion pills. They hope to give pregnant people living in places where abortion is nearly inaccessible, or outright illegal, access to safe and effective ways to take charge of their own fertility.

Thanks to the introduction of abortion pills mifepristone and misoprostol — which, in combination, effectively induce abortion 95 percent to 98 percent of the time — it’s become possible to terminate an unwanted pregnancy without an invasive medical procedure. More to the point, it’s possible for women to take these pills to induce an abortion on their own, without the assistance of a doctor. Those pills can be bought online — so for many people, it’s possible to avoid the clinic entirely.

NAPW Advises Pregnant Women Not to "Self-Report" and the Public to Reject Incoherent and Inaccurate Claims Regarding Pregnant Women

On January 11, 2018, the Big Horn County Attorney's Office issued an announcement calling for the "immediate crackdown" on pregnant women that is outrageous, irresponsible, and dangerous to women, children, and families. According to this statement, every pregnant woman should be constantly monitored for the use of alcohol or non-medically prescribed drugs, turned in to state authorities by friends, family members, health care providers and strangers, and become subject to court orders of protection that may be enforced through arrest and incarceration to "incapacitate" expecting mothers. Pregnant women are advised to "immediately self-report" to the Department of Health and Human Services to avoid prosecution. The County Attorney also calls on other prosecutors throughout Montana to join him in this reckless call to hunt down pregnant women. NAPW is shocked by this attack on the health, liberty, and basic human rights of women in Big Horn County.
