MUMBAI, Sept 6 (Thomson Reuters Foundation) - They didn’t pop open boxes of sweets or send out excited phone messages when their first child was born at public hospital on a rainy Mumbai night in July.

The couple had known from the 24th week of the pregnancy that their child would be born with Arnold Chiari Type II syndrome - a structural defect in the brain.

Since abortions in India are allowed only up to 20 weeks of pregnancy, the couple petitioned India’s Supreme Court to allow them a to terminate the pregnancy, which was by then 27 weeks. The court rejected their plea.

New Delhi: The Supreme Court on Monday set up a medical board to examine the condition of a 13-year-old rape survivor who is seeking permission to abort her 30-week-old foetus.

A Bench comprising Justices S.A. Bobde and L. Nageswara Rao directed that a medical board would be constituted at the Sir JJ Group of Hospitals to examine the minor girl and ascertain the condition and advisability of permitting abortion. “The aforesaid board shall submit a report about the condition and advisability of permitting a medical termination of pregnancy of the petitioner’s daughter forthwith,” the Bench said, and fixed the matter for hearing on August 31.

The parents of a pregnant 13-year-old rape victim from the Indian city of Mumbai have gone to the Supreme Court seeking permission to abort her baby.

The girl is 30 weeks pregnant. Indian law allows terminations after 20 weeks only if the mother's life is in danger.

The pregnancy was discovered after her parents took her to a doctor to seek treatment for obesity.

NEW DELHI: The Supreme Court on Friday said that a minor rape victim should not be forced to knock the doors of the court for getting permission to terminate her pregnancy arising out of any sexual offence.

It also favoured setting up of a trust for the benefit of the Chandigarh-based 10-year-old girl rape survivor, who recently delivered a child after being denied abortion.

The news travelled around the world: the child refused an abortion by both a district court in Chandigarh and the Supreme Court of India, in both cases on the grounds that abortion was too risky at 28 weeks and then again at 32 weeks, was delivered by c-section last week and will be kept in hospital for some 10 days. Although the hospital was reported to say that the child and the 2.2kg premature infant were both “doing fine”, the facts are other: The girl was put through major surgery. She was told a large stone had to be removed from her stomach. How will she feel when she is old enough to know better? Her abusive uncle is in prison. Her parents are shattered from the discovery of the abuse, the publicity the story generated and two failed court cases in which the girl’s interests were the least important item on the agenda and the facts about the safety of abortion at 28 weeks of pregnancy were absent.

The ink had barely dried on this case when another case emerged of a pregnant 12-year-old, also a victim of sexual abuse, also in the late second trimester of pregnancy, who was removed from her parents’ care on spurious grounds when she was first seen in the hospital. Thankfully, the Centre for Enquiry into Health and Allied Themes (CEHAT), who have a 24*7 support service for survivors of rape and sexual abuse, their families and doctors, were able to provide the necessary intervention so that her family got custody of their daughter back again. They will continue to help the girl and her family to cope up with whatever is in store for her. Her situation is uncertain, however. It has so far proved impossible to find a second obstetrician-gynaecologist willing to come forward to authorise/do an abortion on the grounds of serious risk to the girl’s mental health following rape, which is clearly permitted under the 1971 MTP Act.

Last week, however, for the first  time in India, a survivor of rape in Bihar was awarded compensation by the Supreme Court of 600,000 Rs (about US$ 10,600) for the delay in providing her with an abortion. The woman, aged 35, was 26 weeks pregnant. The High Court had called for a medical board to be constituted, to decide if she had a right to an abortion, leading to significant delay. The Supreme Court said the High Court failed to adhere to the stipulation in the MTP Act that abortion can be provided in the case of an allegation of rape. Thus, the Bihar case provides a judgment that advocates think can be built on.

The statistics on the scale of sexual abuse of children in India speak for themselves. The BBC reports that according to UNICEF and Indian government data:

> A child under 16 is raped every 155 minutes, a child under 10 every 13 hours

> More than 10,000 children were raped in 2015

> 240 million women living in India were married before they turned 18

> 53.22% of children who participated in a government study reported some form of sexual abuse

> 50% of abusers are known to the child or are “persons in trust and care-givers”.

The case of the 10 year old victim of rape who is pregnant and awaiting delivery after being denied permission to abort by the courts is an urgent indication that all stakeholders must come together and find a solution for unwanted pregnancies which present after 20 weeks.

Even as the 10-year old pregnant girl whose case has been widely reported in the media awaits deli­very in a hospital in Chandigarh, a 12-year old girl in Mumbai has been found to be 27 weeks pregnant. Both are victims of rape by men known to their families. The first was assaulted over seven months by her uncle while in the latter’s case it was a man who worked with her father and rented a room from the family.

A collective feels it is tantamount to obfuscation of abortion laws, causing undesirable and damaging delays

A collective of public health experts, lawyers, and human rights activists have expressed serious concern over courts repeatedly refusing permission to child rape survivors to undergo abortion and thus forcing the children to carry their unwanted pregnancy to term.

The intervention of courts and the ad hoc medical opinion they receive in such matters tantamount to obfuscating of existing abortion laws, causing undesirable and damaging delays in these cases.

India's Supreme Court has refused to allow an abortion for a 10-year-old girl, allegedly raped by her uncle, on the grounds that she is too far into her pregnancy.

A doctors' panel told the court that, at 32 weeks, termination of the pregnancy would be "too risky".

Her pregnancy was discovered two weeks ago when she complained of stomach ache and her parents took her to hospital. A lower court had earlier turned down her plea on similar grounds.

New Delhi: A 10-year-old raped by her uncle will not be allowed to have an abortion, the Supreme Court ruled today, rejecting the petition by a Supreme Court lawyer. The court said it was basing its decision on the assessment of doctors who said that a medical termination was not safe either for the girl or the foetus. She is 32 weeks pregnant.

The court had earlier this week asked doctors at Chandigarh's PGI to examine the girl to see if an abortion was safe. It has today ordered that proper medical care be provided to the girl child.

On Friday, the Supreme Court refused to allow an abortion for a pregnant 10-year old girl who was raped allegedly by her uncle. The Chandigarh resident’s plea for abortion was turned down last week by the district court. News reports also suggest that she had an anomaly in her heart and had to be operated for it three years ago.

The doctors’ panel at Postgraduate Institute of Medical Education and Research, Chandigarh who examined the girl said that a medical termination was not safe either for the girl or the foetus, NDTV reported.
