UK / SPAIN – The Court of Appeal upholds the legality of a buffer zone around a London abortion clinic

The buffer zone around the clinic was imposed by the London council of Ealing in April 2018, but the call to impose national buffer zones around all clinics was rejected by the Conservative government’s Home Secretary in September 2018, in spite of the existence of strong evidence presented to him for imposing them.

This new judgment, handed down by Lady Justice Eleanor King and Lady Justice Nicola Davies is the first at appeal court level and provides solid case law for backing for other Public Spaces Protection Orders in the future.

Anti-abortion protesters contest ban at Court of Appeal

Anti-abortion campaigners have told judges a "buffer zone" outside a London clinic defies their right to protest.

Attendees of a vigil run by the Good Counsel Network (GCN) have challenged a ban on protests targeting users of the Marie Stopes facility in Ealing.

The 330ft (100m) buffer zone was imposed by Ealing Council in April 2018 after women complained of intimidation.

The first time I went to an abortion clinic, I was in my teens accompanying a friend having a termination.

We talked a lot about what was going to happen. We questioned what you were supposed to wear to go and get abortion pills. We looked up the route from the tube station to the clinic on Google maps.

Calls for abortion clinic buffer zones rejected

Calls for buffer zones to be introduced outside abortion clinics to stop patients being harassed have been rejected by Home Secretary Sajid Javid.

He said such protest-free areas around clinics in England and Wales "would not be a proportionate response".

A Home Office review found cases of harassment and damaging behaviour but they were "not the norm", he added.

Protesters outside Scottish abortion clinics are being monitored by police with a view to a possible crackdown.

Aileen Campbell, the public health minister, said that pro-life protests could be distressing for women and action may be required.

Some councils want “buffer zones” to keep demonstrators away from patients and staff after a surge in pro-life vigils.
